Explanation
The purpose of this ordinance is to amend Ordinance 1014-2021 in order to correct the name of the vendor that is being awarded the contract for the purchase of Knife Gate Valves.
The purpose of Ordinance 1014-2021 was to authorize the Director of Finance and Management to enter into contract for the purchase of Knife Gate Valves to be used by the Division of Sewerage and Drainage, Southerly Wastewater Treatment Plant to replace current valves.
The reason that Public Utilities is requesting this amendment is due to the fact that the original Ordinance 1014-2021, passed by Columbus City Council on May 17, 2021 and signed by the Mayor on May 18, 2021, referenced the vendor name incorrectly. Within the ordinance it allowed for the Director of Finance and Management to enter into contract with Baker & Sons dba Dark Water Solutions under the Federal ID #45-3933625. The company has now confirmed that they will be operating under the name Dark Water Solutions Ltd dba Baker and Associates Ltd.

FISCAL IMPACT: Auditor’s Certificate #ACPR001972 from Ordinance 1014-2021 will be utilized to establish the new contract after this Ordinance has passed. No additional funds are requested at this time.
EMERGENCY DESIGNATION: This ordinance is being submitted as an emergency to allow for the establishment of the contract under the correct company name without delay.

WHEREAS, Ordinance 1014-2021 authorized the Director of Finance and Management to enter into contract with Baker & Sons dba Dark Water Solutions for the purchase of Knife Gate Valves for the Division of Sewerage and Drainage; and
WHEREAS, after passage of Ordinance 1014-2021 it was determined that the company name did not appear correctly in all parts of the ordinance to be used for this contract; and
WHEREAS, it is necessary to correct the company name in all parts of the ordinance so the Director of Finance and Management may proceed with entering into contract with Dark Water Solutions Ltd dba Baker and Associates Ltd for this purchase; and
WHEREAS, Auditor’s Certificate #ACPR001972 from Ordinance 1014-2021 will be utilized to establish the new contract after this Ordinance has passed. No additional funding is necessary or required with this ordinance; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage, in that it is immediately necessary to authorize the amendment so that the Director of Finance and Management may proceed with entering into contract without delay, utilizing the correct company name, for the purchase of Knife Gate Valves with Dark Water Solutions Ltd dba Baker and Associates Ltd, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That Ordinance 1014-2021 be and hereby is amended as follows:

The third lowest bidder, Baker & Sons DBA Dark Water Solutions Dark Water Solutions Ltd dba Baker and Associates Ltd did meet all specifications and therefore, the Division of Sewerage and Drainage recommends an award be made to Baker & Sons DBA Dark Water Solutions Dark Water Solutions Ltd dba Baker and Associates Ltd for all items in the amount of $76,816.00 as the most responsive, responsible and best bidder.

WHEREAS, the Division of Sewerage and Drainage recommends an award be made to the most responsive, responsible and best bidder, Baker & Sons DBA Dark Water Solutions Dark Water Solutions Ltd dba Baker and Associates Ltd; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities to authorize the Director of Finance and Management to enter into a contract with Baker & Sons DBA Dark Water Solutions Dark Water Solutions Ltd dba Baker and Associates Ltd in accordance with the terms, conditions and specifications of Solicitation Number RFQ018116 on file in the Purchasing Office; now, therefore,

That the Director of Finance and Management be and is hereby authorized to establish a contract for all items with Baker & Sons DBA Dark Water Solutions Dark Water Solutions Ltd dba Baker and Associates Ltd for the purchase of Knife Gate Valves for the Department of Public Utilities, Division of Sewerage and Drainage in accordance with RFQ018116 specifications on file in the Purchasing Office.
SECTION 2. That Auditor Certificate No. ACPR001972 is authorized to be utilized with Dark Water Solutions Ltd dba Baker and Associates Ltd (Vendor #034466).
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
