Explanation

 

This legislation authorizes the Director of Public Utilities to renew and extend the contract with 360 Water Inc. for the purpose of migrating the on premise 360 Water Inc. training system to software as a services platform in the cloud.  The scope of the project includes migration of the operating system to the cloud environment, as well as security and software updates.  360 Water Inc. will also be responsible for re-integrating with the Cornerstone Learning Management System, uploading all courses and providing testing and/or training that will be needed to use the new system.

 

The original contract PO230965 was for a period of one (1) year with the option to renew for three (3) additional years, on a year-to-year basis upon mutual agreement, budgeted funds and approval by Columbus City Council.  The Department of Public Utilities, is utilizing the first extension option. This is the 2nd year of a 4 year contract.  The proposed Renewal No. 1 shall extend the contract for a period of one year through and including July 6th 2022, with yearly renewal options for an additional two years.  These contracts shall not automatically renew.  All other terms and conditions of the original agreement remain in full force and effect.  If unforeseen issues or difficulties are encountered that would require additional funding, a modification would be requested.

The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.

 

1. Amount of additional funds:  Total amount of additional funds needed for this contract renewal #1 is $0.00.  Total contract amount including this renewal is $79,000.00.

 

2. Reason additional funds were not foreseen:  The need for additional funds was known and provided for at the time of the initial contract award. This is a planned renewal, but no additional funds are needed at this time.

 

3. Reason other procurement processes were not used:  Work under this renewal is a continuation of services included in the scope of the original bid contract.  No lower pricing/more attractive terms and conditions are anticipated at this time.

 

4. How was cost determined:  The cost, terms, and conditions are in accordance with the original agreement. The cost for this renewal is $0.

Body

 

WHEREAS, the Department of Public Utilities has a contract for professional services in connection with the Department of Public Utilities Training Program; and

 

WHEREAS, the original contract was for a period of one year to and including July 6th, 2021.  The contract language allows for the Department of Public Utilities to renew the contract for three (3) additional years based upon mutual agreement of the parties, availability of budgeted funds, and approval by City Council; and

 

WHEREAS, The Department of Public Utilities wishes to renew the contract with 360 Water Inc. and extend the contract through and including July 6th, 2022; and

 

WHEREAS, if unforeseen issues or difficulties are encountered that would require additional funding, a modification would be requested; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities to authorize the Director of Public Utilities to renew its contract for professional services for the Department of Public Utilities Training Program with 360 Water Inc.; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities be, and hereby is, authorized to renew and extend the contract No. PO230965 with 360 Water, Inc. for professional services for the Department of Public Utilities Training Section, in accordance with the terms and conditions as shown in the agreement on file in the office of the Department of Public Utilities.  The total amount of Renewal No.1 is ADD $0.00.  Total contract amount including this Renewal is $79,000.00.  This renewal will extend the contract through and including July 6th, 2022. 

 

SECTION 2.  That this renewal is in accordance with the relevant provisions of Chapter 329 of City Code, relating to contract renewals.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
