Explanation

1. BACKGROUND
This ordinance will amend Ordinance No. 2027-2021 by authorizing the Director of the Department of Public Service to grant a quit-claim deed in order to transfer fee title to parcel 31B-WL to the Ohio Department of Transportation (ODOT), instead of a permanent easement as originally contemplated, in connection to ODOT’s Roadway Improvements - Far East Freeway Phase 1 (3347-E), ODOT designation FRA-70-22.61, PID 95639.

2. FISCAL IMPACT
There is no fiscal impact to the City.

3. EMERGENCY DESIGNATION
Emergency action is requested in order to allow for the timely granting of the requested quit-claim deed, which will allow construction to proceed per the schedule established by ODOT.

Body

WHEREAS, this ordinance amends the language in Ordinance No. 2027-2021 from granting a permanent easement to quit-claiming fee title to the parcel 31B-WL to ODOT; and

WHEREAS, ODOT will acquire parcel “31-WDV” in the name of the City, at no cost to the City, in order accommodate the adjustment to Scarborough Boulevard; and

WHEREAS, an emergency exists in the usual daily operations of the Department of Public Service in that it is immediately necessary to authorize the Director of Public Service to execute those documents necessary to quit-claim fee title to parcel 31B-WL to ODOT to allow construction to proceed per the schedule established by ODOT, thereby preserving the public health, peace, property, safety, and welfare; now therefore
