AN21-013
BACKGROUND:
This ordinance approves the acceptance of certain territory (AN21-013) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on June 30, 2021. City Council approved a service ordinance addressing the site on July 12, 2021. Franklin County approved the annexation on August 12, 2021 and the City Clerk received notice on August 19, 2021.
FISCAL IMPACT:
Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.
Title
To accept the application (AN21-013) of April M and Helen J Williams for the annexation of certain territory containing 0.4± acres in Mifflin Township.
Body
WHEREAS, a petition for the annexation of certain territory in Mifflin Township was filed by April M and Helen J Williams on June 30, 2021; and
WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on August 12, 2021; and
WHEREAS, on August 19, 2021, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and
WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and
WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. That the annexation proposed by April M and Helen J Williams in a petition filed with the Franklin County Board of Commissioners on June 30, 2021 and subsequently approved by the Board on August 12, 2021 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:
Situate in the State of Ohio, County of Franklin, Township of Mifflin, in Quarter Township 3, Township 1, Range 17, United States Military Lands, being part of the 0.436 Acre tract conveyed to April M. Williams and Helen J. Williams in Instrument Number 201911010145961, all records being of the Recorder's Office, Franklin County, Ohio and being more particularly bounded and described as follows:
BEGINNING at the intersection of the north line of said 0.436 Acre tract and the west right of way line of Johnstown Road, 60 feet wide, being in the south line of a 0.450 Acre tract conveyed to Tonjia D. Brown in Instrument Number 199903310079504 and in the City of Columbus Corporation Line as established by Ordinance Number I 046-59 and recorded in Miscellaneous Record Volume 117, Page 475;
Thence, southwesterly, across said 0.436 Acre tract, along the west right of way line of Johnstown Road and along the existing City of Columbus Corporation Line, approximately 102 feet to the south line of said 0.436 Acre tract, the north line of a 0.421 Acre tract conveyed to City of Columbus, Ohio in Instrument Number 201909170120096 and in the City of Columbus Corporation Line as established by Case Number 41-72, Ordinance Number 1607-72 and recorded in Miscellaneous Record Volume 158, Page 88;
Thence, westerly, along part of the south line of said 0.436 Acre tract, along part of the north line of said 0.421 Acre tract and along the City of Columbus Corporation Line, approximately 122 feet to the southwest comer of said 0.436 Acre tract, the northwest comer of said 0.421 Acre tract, the northeast comer of a 0.021 Acre tract conveyed to State of Ohio in Official Record Volume 9348, Page II 5 and the southeast comer of a 0,064 Acre tract conveyed to State of Ohio in Official Record Volume 6990, Page AO I;
Thence, northeasterly, along the west line of said 0.436 Acre tract, along the east line of said 0.064 Acre tract and continuing along the City of Columbus Corporation Line, approximately 195 feet to the northwest comer of said 0.436 Acre tract, the northeast comer of said 0.064 Acre tract, the southeast comer of a 0.050 Acre tract conveyed to State of Ohio in Official Record Volume 5809, Page H15 and the southwest comer of said 0.450 Acre tract;
Thence, southeasterly, along part of the north line of said 0.436 Acre tract and along part of the south line of said 0.450 Acre tract, approximately 127 feet to the POINT OF BEGINNING, CONTAINING 0.4 ACRES, MORE OR LESS. This description was prepared from record information only and 1s not based on a field survey. This description is for annexation purposes only.
SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
