Explanation

1.  BACKGROUND

This ordinance authorizes the Director of Public Service to enter into a professional services contracts with Environmental Design Group, LLC in an amount of up to $250,000.00 for the Intersection - Cleveland Avenue at Myrtle Avenue project.

 

The intent of this project is to provide the Department of Public Service additional engineering and related services necessary to produce construction plans and associated deliverables for improvements to the intersection of Cleveland Avenue at Myrtle Avenue.  The design includes the realignment of the curve at the north leg of the intersection to meet current standards via resurfacing and restriping; to replace the traffic signal; and to adjust curb alignments. The design may include streetscape improvements within, along, or adjacent to the Cleveland Avenue corridor.

 

The Community Development Block Grant (CDBG) Entitlement Program provides annual grants on a formula basis to entitled cities and counties to develop viable urban communities by providing decent housing and a suitable living environment, and by expanding economic opportunities, principally for low- and moderate-income persons.  Ordinance 2469-2020 established the appropriation of the CDBG Funds to specific projects within the City.

The Department of Public Service, Office of Support Services, solicited Requests for Proposals for the Intersection - Cleveland Ave at Myrtle Ave contract.  The project was formally advertised on the Vendor Services and Bonfire web sites from August 27, 2021, to September 17, 2021The City received one (1) response.  The proposal was deemed responsive and was fully evaluated when the Evaluation Committee met on September 28, 2021.  The responding firm was:

Environmental Design Group, LLC received 83.00 points from the Evaluation Committee out of a possible 90.00 and will be awarded Intersection - Cleveland Ave at Myrtle Ave project.

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Environmental Design Group, LLC.

 

2.  CONTRACT COMPLIANCE

The contract compliance number for Environmental Design Group, LLC is CC003292 and expires 08/10/2023. 

 

3.  FISCAL IMPACT

A reimbursable grant in the Community Development Act Fund, Fund 2248, provided by the U.S. Department of Housing and Urban Development (HUD), is available for this project. Funds will need to be appropriated.

 

4. EMERGENCY DESIGNATION

Emergency action is requested to expedite this contract to complete the project in a timely manner, to ensure the safety of the travelling public.

Body

 

WHEREAS, there is a need to enter into a professional services contract to provide for engineering and related services necessary to produce construction plans and associated deliverables for improvements to the intersection of Cleveland Ave and Myrtle Ave; and

 

WHEREAS, the Department of Public Service, Office of Support Services, solicited Requests for Proposals for the Intersection - Cleveland Ave at Myrtle Ave project; and

 

WHEREAS, Environmental Design Group, LLC submitted the best overall proposal for this project; and

 

WHEREAS, it is necessary to enter into a contract with Environmental Design Group, LLC for the provision of professional engineering consulting services described above in the amount of up to $250,000.00; and

 

WHEREAS, funding is available for this project through a reimbursable grant in Fund 2248, the Community Development Act Fund, provided by the United States Department of Housing and Urban Development; and

 

WHEREAS, funds must be appropriated within the Community Development Act Fund, Fund 2248; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director of Public Service to enter into contract with Environmental Design Group, LLC in order to provide funding for the Intersection - Cleveland Ave at Myrtle Ave so that upcoming construction projects may be governed by updated standards, policies, and practices as soon as possible, to ensure the safety of the travelling public thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2021, the sum of $250,000.00 is appropriated in Fund 2248 (Community Development Act Fund), Dept-Div 5912 (Design and Construction), in Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

SECTION 2.  That the Director of Public Service be, and hereby is, authorized to enter into a professional services contract with Environmental Design Group, LLC located at 88 East Broad Street, Suite 880, Columbus, OH  43215, for the Intersection - Cleveland Ave at Myrtle Ave project in an amount up to $250,000.00.

 

SECTION 3.  That the expenditure of $250,000.00, or so much thereof as may be needed, is hereby authorized in Fund 2248 (Community Development Act Fund), Dept-Div 5912 (Design and Construction), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 4.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 6.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 7.  At the end of the grant period, any repayment of unencumbered balances required by the grantor is hereby authorized and any unused City match monies may be transferred back to the City fund from which they originated in accordance with all applicable grant agreements.

 

SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
