Explanation

 

1.                      Background

In 1962, pursuant to Ordinance 425-62, the City of Columbus transferred a portions of right-of-way known as a north/south alley, south of Lafayette Street between North Fifth Street and Neilston Street and reserved utility easements for existing utilities. The Department of Public Service recently received a request from the property owners, 230 Long St. CP, LLC asking that the City release the reserved easements over this area to clear title for this site. After receipt of this request, the Department of Public Service, Division of Infrastructure Management, verified with all the public and private utility companies there are no public utilities or need for these easements located within the requested area.  The public and private utility companies both have no objections to these portions of the easements being released. The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary to release the portions of easements as described below and attached to this ordinance to allow the area to clear title for this site.

 

2.  Fiscal Impact

The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the request to release the easement.

WHEREAS, the Department of Public Service recently received a request from the property owners, 230 Long St. CP, LLC asking that the City release the reserved easements over this area to clear title for this site; and

 

WHEREAS, the Department of Public Service, Division of Infrastructure Management, verified with all the public and private utility companies that there are no public utilities or need for the easement located within the requested area and that they have no objections to this portion of the easement being released; and

 

WHEREAS, the City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the request to release the easement.

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Service to execute those documents necessary to release the portions of easements as described below and attached to this ordinance to allow the area to clear title for this site; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  To authorize the Director of the Department of Public Service to execute the documents as necessary and approved by the Real Estate Department, City Attorney’s Office, to release the portion of easement area as described below and attached to this ordinance:

 

Easement Area to be released:

 

0.019 ACRE EASEMENT RELEASE

 

Situated in the City of Columbus, County of Franklin, State of Ohio and being part of a 12-foot-wide Public Alley dedicated in the A. Lathem Addition, Plat Book 1, Page 276, as recorded in the Franklin County Recorder’s Office and being more particularly described as follows:

Commencing at the intersection of the centerline of Long Street (82.5 feet wide) with the centerline of Fifth Street (formerly Latham Street) (60 feet wide);

 

Thence along the centerline of Fifth Street North 08̊ 12’ 09” West for a distance of 232.32 feet to a point;

 

Thence North 81̊ 43’ 47” East for a distance of 30.00 feet to the intersection of the easterly right of way of Fifth Street and the southerly right of way of Lafayette Street (20 feet wide), said point also being the northwesterly corner of the grantor’s property and the northwesterly corner of Lot 7 of A. Lathem Addition (Plat Book 1, Page 276);

 

Thence along the southerly line of said Lafayette Street and northerly line of said Lot 7, North 81° 43’ 47” East, for a distance of 166.50 feet to a point at the northeasterly corner of said Lot 7 and the northwesterly corner of a 12-foot-wide Alley dedicated in A. Lathem Addition (Plat Book 1, Page 276), and being the True Point of Beginning;

 

Thence along the northerly line of said 12-foot-wide Alley and the southerly line of said Lafayette Street, North 81° 43’ 47” East, for a distance of 12.00 feet, to a point on the easterly line of said 12-foot-wide alley and being the northwesterly corner of Lot 1 from the Amended Plat of Bernard McNally’s Addition to Columbus O. (Plat book 1, Page 363);

 

Thence along the easterly line of said 12-foot-wide alley and the westerly line of said Lot 1, South 08° 12’ 09” East, for a distance of 69.29 feet to a point at the northeasterly corner of a 12-wide Alley dedicated by City of Columbus Ordinance 426-62;

 

Thence crossing through said 12-foot-wide Alley from A. Lathem Addition (Plat Book 1, Page 276), South 81° 48’ 07” West, for a distance of 18.00 feet to a point on the easterly line of Lot 6 from A. Lathem Addition (Plat book 1, Page 276);

 

Thence along the easterly line of said Lot 6, North 36° 47’ 04” East, for a distance of 8.49 feet to a point;

 

Thence continuing along the easterly of said Lot 6 and the easterly line of Lot 7 from A. Lathem Addition (Plat Book 1, Page 276), North 08o 12' 09” West for a distance of 63.27 feet to the True Point of Beginning and containing 0.019 Acres, more or less, and being subject to all other legal easements, agreements, and rights-of-way of record.

 

 

This description was prepared by Daniel L. Quick, Ohio Professional Surveyor Number 7803 from an actual field survey performed in February 2018.

 

The bearings are based on the bearing of S 81°48'07" W for the north right of way line for East Long Street, which is measured from Grid North, referenced to the Ohio State Plane Coordinate System (South Zone) and the North American Datum of 1983 (2011 adjustment), as established utilizing a GPS survey and OPUS solution.

 

SECTION 2.  The City will receive a total of $500.00, to be deposited in Fund 7748, Project P537650, for granting the request to release the easement.

 

SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
