Explanation

 

Background: This ordinance authorizes the Director of the Recreation and Parks Department to enter into contract with The Righter Co., Inc. for the Lou Berliner Park Utilities Improvements - Phase 2 Project. The base contract amount is $150,300.00, with alternates totaling $105,640.00, and a contingency of $29,060.00, for a total of $285,000.00 being authorized by this ordinance.

 

This project will complete the utility services and site work required to provide restrooms and concession services at the Stand 4 area of Lou Berliner Sports Park. This area is where fields 18 through 25 are located. The first phase of this project extended sanitary sewer service, water service, and electrical service to the Stand 4 area. As the nation’s largest ball diamond complex, Lou Berliner Park services thousands of athletes and spectators from March through November.  These improvements will enable the installation of semi-permanent restrooms and concession facilities for an additional 8 fields, increasing the number of full-service fields from 15 to 23.  The project also includes providing electrical power to ball diamond backstops to install video cameras.

 

Vendor Bid/Proposal Submissions (ODI designation status):

 

Bids were advertised through Vendor Services, in accordance with City Code Section 329, on September 14, 2021 and received by the Recreation and Parks Department on September 23, 2021. This project was also picked up by various local and regional plan rooms and distributed to their membership. Bids were received from the following companies:

 

The Righter Co., Inc. (MAJ): $150,300.00

R.W. Setterlin Building Company (MAJ): $159,273.00

 

After reviewing the bids that were submitted, it was determined that The Righter Co., Inc. was the lowest and most responsive bidder. The Righter Co., Inc. and all proposed subcontractors have met code requirements with respect to prequalification, pursuant to relevant sections of Columbus City Code Chapter 329.

Emergency Justification: Emergency action is requested so the project can begin immediately to minimize impacts on 2022 leagues and tournament schedules.

 

Benefits to the Public: Berliner Sports Park is open to the public and offers numerous leagues that are accessible to the community.  These utilities improvements will improve the services offered at the park.

 

Community Input/Issues: Berliner Sports Park regulars have been requesting additional facilities for concessions and restrooms for over the past decade.  The demand has risen with the quantity of tournaments that are hosted at this location.

Master Plan Relation: This project supports the department’s Master Plan by expanding and improving sports infrastructure, facilities and accessibility.

 

Fiscal Impact: $285,000.00 is budgeted and available from within the Recreation and Parks Voted Bond Fund 7712 to meet the financial obligations of this contract.

Body

 

WHEREAS, it is necessary to authorize the Director of the Recreation and Parks to enter into contract with The Righter Co., Inc. for the Lou Berliner Park Utilities Improvements - Phase 2 Project; and

 

WHEREAS, it is necessary to authorize the transfer of $285,000.00 within the Recreation and Parks Voted Bond Fund 7712; and

 

WHEREAS, it is necessary to authorize the amendment of the 2020 Capital Improvements Budget Ordinance 2707-2021 in order to provide sufficient budget authority for this and future projects; and

 

WHEREAS, it is necessary to authorize the expenditure of $285,000.00 from the Recreation and Parks Voted Bond Fund 7712; and

 

WHEREAS, an emergency exists in the usual daily operations of the Recreation and Parks Department in that it is immediately necessary to authorize the Director to enter into contract with The Righter Co., Inc. to minimize impacts on 2022 leagues and tournament schedules, all for the preservation of the public health, peace, property, safety, and welfare and, NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Recreation and Parks be and is hereby authorized to enter into contract with The Righter Co., Inc. for the Lou Berliner Park Utilities Improvements - Phase 2 Project.

 

SECTION 2. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 5. That the transfer of $285,000.00 or so much thereof as may be needed, is hereby authorized between projects within the Recreation and Parks Bond Fund 7712 per the account codes in the attachment to this ordinance.

 

SECTION 6. That the 2021 Capital Improvements Budget Ordinance 2707-2021 is hereby amended as follows in order to provide sufficient budget authority for this ordinance and future projects.

SECTION 7. For the purpose stated in Section 1, the expenditure of $285,000.00 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the Recreation and Parks Voted Bond Fund 7712 in object class 06 Capital Outlay per the accounting codes in the attachments to this ordinance. 

SECTION 8. That for the reasons stated in the preamble hereto, which is hereby made a part hereof,, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
