Explanation

 

Background: This ordinance is to authorize the Director of the Recreation and Parks Department to modify an existing contract with Midstates Recreation for the 2020 CDBG Linden Early Childhood Development Playground Improvements Project. The modification amount being authorized is $30,000.00, making a new aggregate total of $393,207.50 for this project. The funding for the original contract was provided by the Community Development Block Grant (CDBG) in accordance with the 2020 Annual Action Plan as approved by Council, however, this modification is being funded by the Recreation and Parks Voted Bond Fund.

 

The improvements to the Linden Park Playground adjacent to the Linden Park Early Childhood Education Center is focused upon providing safe and accessible play opportunities for children of all abilities in the Linden Park educational curriculum as well as those throughout the community. This new playground will exceed current accessibility standards with updated rubberized safety surfacing and adaptive play equipment.  The play equipment design is state of the art with ground level play interaction encouraging universal accessibility and cooperative play. 

 

The requested modification for Midstates Recreation is $30,000.00 and is a direct result of site changes during the construction of the Linden Community Center. These changes resulted in a redesign of playground foundations to accommodate new utilities in this area that were not foreseen when this project was initially designed and awarded.  Additional coordination with the adjacent Linden Park School also resulted in increased quantities of the perimeter fencing of the playground. Initiating another procurement process for the services is not viable as the Department was already in contract with Midstates Recreation for this work.  This fee was calculated by the cost of time, materials, and labor needed to complete the playground construction using rates already established in the contract.

Emergency Justification: Emergency action is requested to allow for the project to be closed out by the end of the year.

 

Benefits to the Public: Safe and accessible playgrounds are one of the core charges of the Recreation and Parks Department. The Department monitors the life span of play spaces routinely to make sure that safe, quality equipment is provided to the public.

Master Plan Relation: This project supports the Recreation and Parks Departments’ Master Plan by providing one of the top needs of the community, which are improvements to neighborhood parks that provide opportunities for fitness and wellness.

 

Fiscal Impact: The expenditure of $363,207.50 was legislated for the 2020 CDBG Linden Early Childhood Development Playground Improvements Project by Ordinance 2053-2020. This ordinance will provide funding that will modify the previously authorized amount by $30,000.00. $30,000.00 is budgeted and available from within the Recreation and Parks Voted Bond Fund 7702 to meet the financial obligations of this contract modification. The aggregate total amount authorized, including this modification, is $393,207.50.

To authorize the Director of Recreation and Parks to modify an existing contract with Midstates Recreation for the 2020 CDBG Linden Early Childhood Development Playground Improvements Project; to authorize the expenditure of $30,000.00 from the Recreation and Parks Voted Bond Fund 7702; and to declare an emergency. ($30,000.00)

 

Body

 

WHEREAS, it is necessary to authorize the Director of the Recreation and Parks to modify an existing contract with Midstates Recreation for the 2020 CDBG Linden Early Childhood Development Playground Improvements Project; and

 

WHEREAS, it is necessary to authorize the expenditure of $30,000.00 from the Recreation and Parks Voted Bond Fund 7702; and

 

WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to authorize the Director to modify this contract to allow for the project to be closed out by the end of the year, adding to the preservation of public health, peace, property, safety, and welfare and, NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Recreation and Parks be and is hereby authorized to modify an existing contract with Midstates Recreation for the 2020 CDBG Linden Early Childhood Development Playground Improvements Project.

 

SECTION 2. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 5. For the purpose stated in Section 1, the expenditure of $30,000.00 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the Recreation and Parks Voted Bond Fund 7702 in object class 06 Capital Outlay per the accounting codes in the attachments to this ordinance.

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
