Explanation

1.  BACKGROUND

This ordinance authorizes the Director of Public Service to enter into agreements with and to provide funding to the Ohio Department of Transportation (ODOT) relative to the FRA-US40-15.27 Urban Paving project, PID 106274.

 

The aforementioned effort, which is slated to commence in the summer of 2022, encompasses resurfacing a portion U.S. 40 (East Broad Street), in the vicinity of the structure over Alum Creek to Westland Avenue, and associated work, including partial pavement repair.

 

Ordinance 1728-2021 authorized the Director of Public Service to grant consent and propose cooperation with ODOT relative to the FRA-US40-15.27 Urban Paving project, PID 106274 for the aforesaid project and noted that the encumbrance and expenditure of requisite funding would be authorized under a separate ordinance. The purpose of this ordinance is to enable the Department of Public Service to satisfy its administrative and financial obligations related to that effort.

 

2.  FISCAL IMPACT

Funding in the amount of up to $100,000.00 is available within the Streets and Highways Bond Fund within the Department of Public Service to support the local share of estimated construction costs; however, the final cost to the City may vary based on the results of the competitive bidding process administered by ODOT. An amendment to the 2021 Capital Improvement Budget is necessary to align budget authority with the proper project.  It is also necessary to transfer cash and appropriation between projects within the Streets and Highways Bond Fund to align cash with the proper project.

 

3.  EMERGENCY DESIGNATION

Emergency action is requested in order to maintain the project schedule established by ODOT and to promote highway safety.

 

Title

To amend the 2021 Capital Improvement Budget; to authorize the transfer of cash and appropriation between projects within the Streets and Highways Bond Fund; to authorize the Director of Public Service to enter into agreements with and to provide funding to the Ohio Department of Transportation relative to the FRA-US40-15.27 Urban Paving project; to authorize the expenditure of up to $100,000.00 to support that project; and to declare an emergency.  ($100,000.00)

 

Body

WHEREAS, the Ohio Department of Transportation (ODOT) proposes resurfacing a portion of U.S. 40 (East Broad Street), in the vicinity of the structure over Alum Creek to Westland Avenue, and to perform other associated work, including partial pavement repair; and

 

WHEREAS, the aforementioned project is located within the Columbus corporate boundaries; and

 

WHEREAS, Ordinance 1728-2021 authorized the Director of Public Service to grant consent and to agree to cooperate with ODOT relative to the FRA-US40-15.27 Urban Paving project, PID 106274; and

 

WHEREAS, the City agrees to assume and bear one hundred percent (100%) of the entire cost of the improvement within Columbus city limits less the amount of Federal-Aid funds set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation; and

 

WHEREAS, this ordinance authorizes the Director of Public Service to enter into agreements with and to make payment to ODOT relative to the aforementioned project; and

 

WHEREAS, it is necessary to authorize an amendment to the 2021 Capital Improvement Budget for the purpose of providing sufficient budget authority for the aforementioned project expenditure; and

 

WHEREAS, a transfer of cash and appropriation between projects within the Streets and Highways Bond Fund is required to align cash with the proper project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize consent and cooperation for this project in order to maintain the schedule established by ODOT and to promote highway safety, thereby preserving the public health, peace, property, safety and welfare; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2021 Capital Improvement Budget authorized by Ordinance 2707-2021 be and is hereby amended to provide sufficient budget authority for the expenditure as follows:

SECTION 2. That the transfer of $25,245.23, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5913 (Traffic Management), Project P531053-100000 (Roadway - Dublin Road (US 33) Erosion Emergency Repair), in Object Class 06 (Capital Outlay), to Dept-Div 5911 (Infrastructure Management), Project P530282-100158 (Resurfacing - Urban Paving - East Broad St - Nelson Rd to Westland Ave PID106274), in Object Class 06 (Capital Outlay), per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the transfer of appropriation in the amount of $13,058.03, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5912 (Design and Construction), Project P530282-932018 (Resurfacing - 2018 Project 3), in Object Class 06 (Capital Outlay) to Dept-Div 5911 (Infrastructure Management), Project P530282-100158 (Resurfacing - Urban Paving - East Broad St - Nelson Rd to Westland Ave PID 106274), in Object Class 06 (Capital Outlay), per the accounting coded in the attachment to this ordinance.

 

SECTION 4.  That the Director of Public Service be and hereby is authorized to enter into a contribution agreement, and any amendments or modifications thereto as may be necessary, with the Ohio Department of Transportation (ODOT) and to make payment to ODOT relative to the FRA-US40-15.27 Urban Paving project, PID 106274.

 

SECTION 5.  That the expenditure of $100,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 5911 (Infrastructure Management), Project P530282-100158 (Resurfacing - Urban Paving - East Broad St - Nelson Rd to Westland Ave PID106274), in Object Class 06 (Capital Outlay), per the accounting codes in the attachment to this ordinance.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 8.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
