Title: To authorize the Finance and Management Director to establish a purchase order with S.A. Explanation

 

BACKGROUND:  This ordinance authorizes the Finance and Management Director to establish a purchase order on behalf of the Facilities Management Division, with S.A. Comunale, Inc. for annual smoke and fire alarm testing, inspection and repair, as well as sprinkler inspections, fire pump testing, and fire suppression testing for city-owned facilities based on a pending State of Ohio Master Maintenance Agreement.  Due to the critical nature of fire inspection services required by the Division of Facilities Management, we respectfully request that the competitive bidding provisions of the Columbus City Code be waived to continue this relationship with the existing provider. The City is currently preparing a Best Value Procurement process to competitively select the a future service provider. This purchase order with SA Comunale is intended to continue existing services until such procurement process is completed.

Ordinance No. 582-87 authorizes City agencies to participate in Ohio Department of Administrative Services (DAS) cooperative contracts.

Emergency action is requested so that purchase orders can be established as quickly as possible to ensure an uninterrupted continuation of services.

 

Fiscal Impact:  The Facilities Management Division 2022 general fund budget has sufficient funding to cover this expenditure. The Facilities Management Division budgeted $250,000.00 in the 2021 general fund budget for these services.

Body

 

WHEREAS, the Facilities Management Division has a need for annual smoke and fire alarm testing, inspection and repair, as well as sprinkler inspections, fire pump testing, and fire suppression testing for city-owned facilities under the purview of the Facilities Management Division; and

 

WHEREAS, the Facilities Management Division has a need for funding for costs for fire safety systems and repairs under the purview of the Facilities Management Division; and

 

WHEREAS, it is necessary to utilize a pending State of Ohio Master Maintenance Agreement with S.A. Comunale;

 

WHEREAS, Ordinance No. 582-87 authorizes City agencies to participate in Ohio Department of Administrative Services (DAS) cooperative contracts; and

 

WHEREAS, the City is currently preparing a Best Value Procurement process to competitively select the a future service provider and this purchase order with SA Comunale is intended to continue existing services until such procurement process is completed; and

 

WHEREAS, it is necessary to waive the competitive bidding provisions of Columbus City Code so that the existing contractor can continue provided necessary services until the best value procurement process can be completed; and

 

WHEREAS, an emergency exist in the usual daily operation of the Department of Finance and Management in that it is immediately necessary to authorize the Director to establish a contract for annual smoke and fire alarm testing, inspection and repair, sprinkler inspections, fire pump testing, and fire suppression testing with S.A. Comunale for city facilities, so that there is no interruption in services, thereby preserving the public health, peace, property, safety, and welfare; NOW, THEREFORE:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Finance and Management Director, on behalf of the Facilities Management Division, is hereby authorized to establish purchase orders pursuant to the terms and conditions of a pending State of Ohio Master Maintenance Agreement with S.A. Comunale.

 

SECTION 2.  That the expenditure of $150,000.00, or so much thereof that may be necessary in regard to the action authorized in Section 1 and Section 2, is hereby authorized in the General Fund 1000, in Object Class 03 - Contractual Services, per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That this Council finds that it is in the City's best interests to waive the competitive bidding provisions of Columbus City Code Chapter 329 to enter into this contract, and the same are hereby waived. 

 

SECTION 4.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5.  That the monies in the foregoing Sections shall be paid upon order of the Director of Finance and Management, and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 8.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
