Explanation

 

This legislation authorizes the Director of Public Utilities to enter into a contract renewal with Johnson Controls Fire Protection LP (formerly SimplexGrinnell LP) for life safety system maintenance services. This contract, FEM 1390.2, will provide for inspections, diagnostic tests and repairs for all accessible peripheral devices currently connected to the life safety systems at the Jackson Pike (JPWWTP) and Southerly (SWWTP) Wastewater Treatment Plants and the Sewer Maintenance Operations Center (SMOC) at 1250 Fairwood Avenue.

 

There is a need for inspections and diagnostic tests for all accessible peripheral devices currently connected to the fire protection systems. These systems include the fire alarm detection and fire sprinkler components that protect the assets contained in the various facilities. The contract will provide for repair and necessary documentation to log all accessible components and devices, detector cleaning for fire alarm and detection systems, emergency service call and labor for the fire alarm 24 hours, 7 days a week, and panel and peripheral component replacement for the various electronic systems. Under the contract, the accessible peripheral devices will be functionally tested in accordance with the National Fire Protection Association's 72 (NFPA) and manufacturer’s recommended procedures.

 

This ordinance is being submitted in accordance with the relevant provisions of Chapter 329 of City Code relating to sole-source procurement. Johnson Controls Fire Protection LP is the sole provider of the monitoring, maintenance and diagnostic testing of the systems.

 

The original contract covers a five-year period from July 25, 2018 through July 24, 2023. For each year of the contract, funding is subject to the approval, by ordinance, of City Council and certification of funds by the City Auditor. This proposed renewal #4 is for the fifth and final year of the contract. If unforeseen issues or difficulties are encountered that would require additional funding or other changes, a modification would be requested.

 

1. Amount of additional funds:  Total amount of additional funds needed for this contract renewal #4 is ADD $70,000.00. Total contract amount including this renewal is $324,390.57.

 

2. Reason additional funds were not foreseen:  The need for additional funds was known at the time of the initial contract. This renewal is to provide the additional funding necessary for the payment of services provided through July 24, 2023.

 

3. Reason other procurement processes were not used:  Work under this renewal is a continuation of services included in the scope of the original bid contract. No lower pricing/more attractive terms and conditions are anticipated at this time.

 

4. How cost was determined:  The cost, terms and conditions are in accordance with the original agreement.

Body

 

WHEREAS, there is a need for life safety system maintenance services at the Southerly Wastewater Treatment Plant, Jackson Pike Wastewater Treatment Plant, and Sewer Maintenance Operations Center; and

 

WHEREAS, Johnson Controls Fire Protection LP (formerly SimplexGrinnell LP) is the sole provider of the monitoring, maintenance and diagnostic testing of the systems, which include the fire alarm detection and fire sprinkler components that protect the assets contained in the various facilities; and

 

WHEREAS, Johnson Controls Fire Protection LP currently provides monitoring and inspection of the security system, including fire alarm detection, on a 24 hour, 7 days a week basis; and

 

WHEREAS, the original contract anticipated that services under this agreement would be provided over a five (5) year period, on a year-to-year basis, based on funding availability, mutual agreement by both parties, approval of City Council, and certification of funds by the City Auditor; and

 

WHEREAS, the Department of Public Utilities, Division of Sewerage and Drainage wishes to renew the agreement with Johnson Controls Fire Protection LP, in accordance with the relevant provisions of Chapter 329 of City Code relating to sole-source procurement, to provide the necessary funding and extend the contract through and including July 24, 2023; and

 

WHEREAS, the City may, at any time during the performance of the services under this contract, propose a modification by a properly authorized written instrument. With the approval of City Council and execution of such modification by both parties hereto, it shall be fully incorporated into this contract and shall govern all subsequent performance under the contract; and

 

WHEREAS, the expenditure of $70,000.00, or so much thereof as may be needed, is hereby authorized in Fund 6100, Sewer Operating Sanitary Fund, in object class 03, Services, per the accounting codes in the attachment to this ordinance; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage, to authorize the Director of Public Utilities to enter into a contract renewal with Johnson Controls Fire Protection LP for life safety system maintenance services; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities is hereby authorized to renew contract #PO289202 (FEM 1390.2) with Johnson Controls Fire Protection LP, 6175 Shamrock Court Suite S, Dublin, Ohio 43016, for life safety system maintenance services for the Division of Sewerage and Drainage at its Sewer Maintenance Operations Center and Southerly and Jackson Pike Wastewater Treatment Plants. Total amount of renewal #4 is ADD $70,000.00. Total contract amount including this renewal is $324,390.57. This renewal will extend the contract through and including July 24, 2023.

 

SECTION 2.  That this renewal is in accordance with the relevant provisions of Chapter 329 of City Code relating to sole-source procurement.

 

SECTION 3.  That the expenditure of $70,000.00, or so much thereof as may be needed, is hereby authorized in Fund 6100, Sewer Operating Sanitary Fund, in object class 03, Services, per the accounting codes in the attachment to this ordinance.

 

SECTION 4.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
