Explanation

 

1. BACKGROUND:  This Ordinance authorizes the Director of Public Utilities to modify and increase the professional engineering services agreement with Resource International, Inc. for the N. Sixth Street & E. Third Avenue Water Line Improvements, Capital Improvements Project No. 690236-100157, Division of Water Contract No. 2363.

 

The original agreement (PO229612) was established for the Division of Sewerage and Drainage, Stormwater Section’s Second Avenue Sewer Improvements Project (CIP 611707), which entailed the evaluation and design of new storm sewers including green infrastructure (GI) requirements.

 

The original scope of work did not envision disturbing the water mains or the street surface above, however, the evaluation of GI alternatives has resulted in a recommendation to replace the full width of the existing brick streets with permeable pavers.

 

Due to the extent of pavement replacement within the project area the Division of Water has determined it beneficial to modify and increase Stormwater’s current agreement to add work to replace water lines and connected service lines while the pavement is disturbed. Since pavement replacement is a substantial cost to a typical water line replacement project, by installing the water mains as part of this project, rather than doing a future standalone project, the Division can avoid a significant cost.

 

This project is located in the “47 - Italian Village” community planning area.  The extent of the waterline replacement is in N. Sixth St. between E. Second Ave. and E. Fourth Ave. (~ 1200 L.F. of 6” diameter water main to be replaced with 8”) and E. Fourth Ave. between N. Sixth St. and East Alley (~ 200’ of 6” diameter water main).

1.2. Reasons additional goods/services could not be foreseen:  

The original scope of work did not envision disturbing the water mains or the street surface above them.  The evaluation of GI alternatives has resulted in a recommendation to replace the full width of the existing brick streets with permeable pavers on N. Sixth St. between E. Second Ave. and E. Fourth Ave.   Since pavement replacement can contribute to a substantial portion of a typical water line replacement project, by installing the water mains as part of this project rather than a future standalone project, the Division can avoid a significant future cost. 

 

1.3. Reason other procurement processes are not used: 

Incorporating the water line work into the Stormwater design documents eliminates duplication of effort that would be required if different engineers were developing independent plans.  Additionally, by having one design professional responsible for the project rather than two eliminates the need and cost of coordination between different designers.  The proposed work to be added represents approximately 2% of the current contract price.  Administrative costs to have a different company design and manage a separate contract can reasonably be expected to far exceed any cost saving by bidding the work.

 

1.4. How cost of modification was determined:

For the additional services a cost proposal was requested from and provided by the design professional.  The hours for the work were reviewed by DOW and determined to be reasonable.  The hourly rates were consistent with the existing contract Schedule 2B labor rates for 2022.  A Schedule 2A for Resource International, Inc. covers this effort.

 

2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT: 

The goal of the water line project is to replace the existing water lines that have exceeded their useful life.  Replacement of these water lines will improve water service, decrease burden on water maintenance operations, and reduce water loss.  The Neighborhood Liaison(s) will be contacted and informed of this project during the design phase.  Further community outreach may result through the Neighborhood Liaison Program.

 

3. CONTRACT COMPLIANCE INFO:  31-0669793, expires 1/31/24, FBE, DAX No. 4197

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Resource International, Inc.

 

4. FISCAL IMPACT:  There are sufficient funds within the Water G.O. Bonds Fund - Fund No. 6006, however, an amendment to the 2021 Capital Improvements Budget will be necessary.

To authorize the Director of Public Utilities to modify and increase the professional engineering services agreement with Resource International, Inc., for the N. Sixth Street & E. Third Avenue Water Line Improvements Project; for the Division of Water; to authorize an expenditure up to $15,730.97 within the Water General Obligations Bond Fund; and to amend the 2021 Capital Improvements Budget.  ($15,730.97)

WHEREAS, Contract No. PO229612 was authorized by Ordinance No. 0907-2020, passed May 18, 2020, was executed on June 18, 2020, and approved by the City Attorney on June 23, 2020, for the Division of Sewerage and Drainage, Stormwater Section’s Second Avenue Sewer Improvements Project; and

 

WHEREAS, Modification No. 1 (current) is needed by the Division of Water to add water line replacement work.  Since pavement replacement can contribute to a substantial portion of a typical water line replacement project, installing the water mains as part of this project, rather than a future standalone project, can avoid significant future costs; and

 

WHEREAS, it is necessary to authorize the Director of Public Utilities to modify and increase the professional engineering services agreement with Resource International, Inc. for the N. Sixth Street & E. Third Avenue Water Line Improvements Project; and

 

WHEREAS, it is necessary to authorize an expenditure of funds within the Water G.O. Bonds Fund - Fund No. 6006, for the Division of Water; and 

 

WHEREAS, it is necessary to authorize an amendment to the 2021 Capital Improvements Budget for purposes of providing sufficient funding and expenditure authority for the aforementioned project expenditure; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, Division of Water, to authorize the Director of Public Utilities to modify and increase the professional engineering services agreement with Resource International, Inc., for the N. Sixth Street & E. Third Avenue Water Line Improvements Project, for the preservation of the public health, peace, property, safety and welfare; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities is hereby authorized and directed to modify and increase the professional engineering services agreement with Resource International, Inc., FID #31-0669793, 6350 Presidential Gateway, Columbus, OH 43231; for the N. Sixth Street & E. Third Avenue Water Line Improvements Project, in an amount up to $15,730.97.

 

SECTION 2.  That this Modification is in compliance with Chapter 329 of Columbus City Codes.  There are no additional modifications anticipated for this project.

 

SECTION 3.  That the 2021 Capital Improvements Budget is hereby amended, in the Water G.O. Bond Fund - Fund No. 6006, per the account codes in the attachment to this ordinance.

 

SECTION 4. That the expenditure of $15,730.97 or so much thereof as may be needed, is hereby authorized within the Water G.O. Bond Fund - Fund No. 6006, in Object Class 06 - Capital Outlay, for construction, per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 7.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 9.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
