Explanation

1.  BACKGROUND

This ordinance authorizes the transfer of signature authority from the Chief Innovation Officer to the City’s Director of Public Service or the Director of Public Service’s designee for all past, present and future contracts and modifications entered into by the City of Columbus in connection to the Smart Columbus - CVE On-Board Unit System Integrator project with Yunex LLC, along with all future documents requiring signature until the project is completed.

This second modification will authorize the Director of Public Service to modify a professional services contract with Yunex LLC to add additional funds for support and maintenance of the Smart Columbus - CVE On-Board Unit System Integrator.

Ordinance 1669-2019 authorized the Chief Innovation Officer to enter into a professional services contract with Yunex LLC for the Smart Columbus - CVE On-Board Unit System Integrator project.  As part of Columbus’ overall response to the Smart City Challenge, the Smart Columbus Program Management Office (PMO) engaged a consultant capable of and qualified to integrate connected vehicles into the City’s transportation environment by installing technology into vehicles to communicate with the environment; and develop and deploy the CV applications that enable the enhanced safety and mobility features Smart Columbus desires. 

 

Ordinance 1204-2021 authorized modification 1 which was necessary for support and maintenance on Connected Vehicles on-board equipment and applications for vehicle-to-vehicle (V2V), vehicle-to-infrastructure (V2I) Safety and Mobility applications. 

 

This is a planned modification and is needed to maintain and operate the Columbus Connected Vehicle Environment which currently has 900 vehicles including over 300 Columbus vehicles with the 78 Roadside Units operating at traffic signals.  Over $7 million of investment was put into the Connected Vehicle Environment project and has always been planned to be maintained after the Smart Columbus grant period expires.  This modification will last into mid-2023.

 

Yunex LLC’s past work with other connected vehicles projects is extensive.  No other company has this type of solution to allow a operation of the robust system.  It was deemed to be the best course of action to modify the existing contract than to bid this part of the work.

Searches in the System for Award Management (Federal) and the Findings for Recovery list (State) produced no findings against Yunex LLC.

 

2.  CONTRACT COMPLIANCE

The contract compliance number for Yunex LLC is CC026824 and expires 01/21/2023.

 

3.  FISCAL IMPACT

Funding for this contract is budgeted, available, and appropriated within Fund 2265, the Street Construction Maintenance and Repair Fund.

 

4.  EMERGENCY DESIGNATION

Emergency designation is requested to allow for the timely execution of the contract modification to support and maintain the Connected Vehicle on-board equipment without delay.

WHEREAS, Ordinance 1669-2019 authorized the Chief Innovation Officer to enter into a professional services contract with Yunex LLC, in the amount of $5,100,000.00, for the provision of various design services related to the Smart City Challenge; and

 

WHEREAS, Ordinance 1204-2021 authorized the Chief Innovation Officer to modify a professional services contract with Yunex LLC, in the amount of $160,000.00, for support and maintenance on Connected Vehicles on-board equipment and applications; and

 

WHEREAS, it is necessary to authorize the Chief Innovation Officer to transfer signature authority to the Director of Public Service or the Director of Public Service’s designee for all past, present and future contracts and modifications entered into by the City of Columbus in connection to the Smart Columbus - CVE On-Board Unit System Integrator project with Yunex LLC; and

 

WHEREAS, it has become necessary to modify the contract in an amount up to $150,000.00 and provide additional funds for the Smart Columbus - CVE On-Board Unit System Integrator project; and

 

WHEREAS, it is necessary to expend funds relative to the project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to enter into a contract modification with Yunex LLC to prevent delays in the project schedule,  to preserve the safety of the traveling public thereby preserving the public health, peace, property, safety, and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Chief Innovation Office be, and is hereby, authorized to transfer signature authority to the Director of Public Service or Director of Public Service’s designee for all past, present and future contracts and modifications entered into by the City of Columbus in connection to the Smart Columbus - CVE On-Board Unit System Integrator project with Yunex LLC.

                     

SECTION 2.  That the Director of Public Service, be, and hereby is, authorized to enter into a contract modification with Yunex LLC, 9225 Bee Cave Road, Building B, Suite 101, Austin, Texas, 78733, for the Smart Columbus - CVE On-Board Unit System Integrator project in the amount of $150,000.00, or so much thereof as may be needed, for the support and maintenance of services related to the project.

 

SECTION 3.  That the expenditure of $150,000.00, or so much thereof as may be necessary, be and is hereby authorized in Fund 2265 (Street Construction Maintenance and Repair Funds), Dept-Div 5913 (Traffic Managment), in Object Class 03 (Professional Services) per the accounting codes in the attachment to this ordinance.

 

SECTION 4.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
