Explanation

 

BACKGROUND:  This ordinance authorizes the Finance and Management Director to enter into a contract for the purchase of pistols for police recruits from Vance Outdoors, Inc. as a result of competitive bidding.  The Division of Police needs to purchase two hundred and seventy (270) Smith and Wesson M&P full size 9mm semi-automatic pistols for the new recruit classes and lateral class that begin June through December 2022.

 

Bid Information:   Formal Bid # RFQ021340 was opened on April 22, 2022.   Vance Outdoors was the most responsive.  However, due to exceptions being taken on specifications, in section 3.3.1 for the Magazine disconnect and section 3.3.1.11 for the coating on the magazines; the Division is asking for a Bid Waiver to purchase the pistols and is also asking to increase the number of pistols from two hundred and fifteen (215) pistols to two hundred and seventy (270) to meet anticipated class sizes.

 

This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

EMERGENCY DESIGNATION: Emergency legislation is requested to provide these pistols to recruits that are expected to start from June through December 2022.

 

FISCAL IMPACT:   This ordinance authorizes the purchase of two hundred and seventy (270) Smith and Wesson M&P full size automatic pistols from Vance Outdoors, Inc. in the amount of $115,921.80 from the General Fund for the Division of Police. Funding is available within the division's 2022 general fund appropriation.

To authorize and direct the Director of Finance and Management to enter into a contract with Vance Outdoors, Inc. for the purchase of semi-automatic pistols for the Division of Police; to authorize the expenditure of $115,921.80 from the General Fund; to waive the competitive bidding provisions of City Code Chapter 329; and to declare an emergency ($115,921.80)

 

Body

 

WHEREAS, a formal bid opening was held on April 22, 2022 for the purchase of semi-automatic pistols for the Division of Police; and,

 

WHEREAS, Vance Outdoors, Inc. was the most responsive bidder; and,

 

WHEREAS, Vance Outdoors, Inc took exceptions to the bid, however, it has been determined to be in the best interests of the City to waive bidding to accept the bid in order to purchase these semi-automatic pistols and to increase the quantity to be purchased; and,

 

WHEREAS, it is necessary to authorize the Director of Finance and Management to enter into a contract for the purchase of semi-automatic pistols for the Division’s incoming recruits; and,

 

WHEREAS, an emergency exists in the usual daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to authorize the Director of Finance and Management to enter into contract with Vance Outdoors, Inc. to purchase these semi-automatic pistols for the upcoming class of police recruits and lateral transfers, for the immediate preservation of the public peace, health, property, safety and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Finance and Management be and is hereby authorized and directed to enter into a contract with Vance Outdoors, Inc. for the purchase of two hundred and seventy (270) semi-automatic pistols for the Division of Police, Department of Public Safety, based on the above vendor's bid being the lowest and best bid received.

 

SECTION 2. That this Council finds that it is in the best interests of the City to waive the competitive bidding provisions of City Code Chapter 329 to enter into this contract.

 

SECTION 3. That the expenditure of $115,921.80 or so much thereof as may be needed, is hereby authorized in the General Fund in object class 02 Material and Supplies per the accounting codes in the attachment to this ordinance:

 

SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
