Title: To authorize the Director of the Department of Development to enter into an Economic Development Agreement with the City of Dublin for the purpose of expanding the “Revenue Sharing Area” of the Water Service Contract and the sewer Service Contract in which Dublin would have the exclusive right to annex the property and the Parties would share net income tax generated within the expanded Revenue Sharing Area; and to declare an emergency.

Explanation

 

BACKGROUND: This ordinance authorizes the Director of the Department of Development to enter into an Economic Development Agreement with the City of Dublin.  Columbus City Council, per ordinance number 0454-2009, passed on July 13, 2009, authorized the Director of the Department of Development to establish a “Revenue Sharing Area” within the “Negotiated Expansion Area” of the Water Service Contract and the Sewer Service Contract whereby Dublin would have exclusive rights to annex the property. The legislation also authorized the City of Columbus and Dublin to propose an Economic Development Agreement for the sharing of income tax revenue generated from the Revenue Sharing Area.

 

This ordinance would authorize the Director to enter into an Economic Development Agreement with the City of Dublin for the purpose of expanding the “Revenue Sharing Area” within the Columbus “Exclusive Service Area” of the Water Service Contract and the Sewer Service Contract in which Dublin would have the exclusive right to annex the property and the Parties would share net income tax generated within the expanded Revenue Sharing Area.       

 

FISCAL IMPACT: No funding is required for this legislation.

WHEREAS, Ordinance number 0454-2009, passed by Columbus City Council on July 13, 2009, authorized the Director of the Department of Development to enter into an Economic Development Agreement with the City of Dublin for the purpose of establishing the “Revenue Sharing Agreement’ within the “Negotiated Expansion Area” of the Water Service Contract and the Sewer Service Contract whereby Dublin has the exclusive right to annex the property; and

         

WHEREAS, the City of Columbus and Dublin, per the ordinance, would also share income tax revenue generated from the Revenue Sharing Area; and

 

WHEREAS, the City of Columbus and Dublin entered into an agreement on April 13, 1993 to provide for the modification of the Dublin Exclusive Area by expanding that area into the Columbus “Exclusive Service Area” and “Negotiated Expansion Area”, and

 

WHEREAS, the City of Columbus and Dublin want to promote economic development and job creation opportunities within the Revenue Sharing Area; and

 

WHEREAS, the City of Columbus and Dublin have agreed to work cooperatively on important regional growth and water safety issues to assure that regional growth and development is served properly and environmentally responsible by centralized water and sewer systems; and      

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to authorize the Director to enter into an Economic Development Agreement with the City of Dublin for the purpose of expanding the “Revenue Sharing Area” and share the net income tax generated within the expanded Revenue Sharing Area” and the resulting creation and retention of jobs; such immediate action being necessary to assure coordination with service agreements and to assure the prompt collection of revenue all for the preservation of the public health, peace, property, safety and welfare; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.                     That the Director of the Department of Development is authorized to enter into an Economic Development Agreement with the City of Dublin, Ohio for the purpose of expanding the “Revenue Sharing Area” and the sharing of net income tax generated within the expanded “Revenue Sharing Area.”

 

SECTION 2.                     For the reasons stated in the Preamble hereto, which is hereby made a part hereto, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor or ten days after the passage if the Mayor neither approves nor vetoes the same.
