Explanation

This ordinance amends previously approved ordinance 2216-2022 by modifying the funding source and associated agreements.

 

Ordinance 2216-2022, authorized the Director of the Department of Finance and Management to enter into grant agreements with Planned Parenthood of Greater Ohio and Ohio Women’s Alliance, both 501(c)(3) not for profit corporations, in support of ensuring Access to Reproductive Healthcare. These funds will be used to provide practical support and medically accurate and legal reproductive health information to residents of the City of Columbus. “Access to Reproductive Healthcare,” as used in this ordinance, includes patient support expenses that arise in the pursuit of reproductive healthcare, such as transportation, lodging, childcare, and lost wages; information hotlines, peer support, and case management; community education and engagement regarding reproductive health; and operational needs of the grantees stemming from providing such supports to the public. “Access to Reproductive Healthcare” does not include the use of public funds to subsidize abortion procedures and associated services such as anesthesia, laboratory tests, or hospital services.

 

Through the American Rescue Plan, this legislation authorizes the Director of the Department of Finance and Management to enter into subaward not for profit services contracts with Ohio Women's Alliance and Planned Parenthood of Greater Ohio in an amount up to $500,000.00 each to add needed reproductive health support services for residents of the City of Columbus. This legislation also authorizes the expenditure of up to $1,000,000.00 for these services within the Department of Finance and Management's allocation in the Recovery Fund 2209. Importantly, all expenses must be eligible under the United States Treasury American Rescue Plan guidelines. Expenses must be necessary expenditures incurred and related to disproportunately impacted populations due to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19).

 

These contracts shall be awarded pursuant to Columbus City Codes Section 329.30: Process for awarding not-for-profit service contracts estimated to exceed fifty thousand dollars ($50,000.00). The services contemplated under these subaward contracts cannot be provided by existing City employees as the City lacks the necessary personnel.

 

Fiscal Impact: No additional funding is required to administer this change. This ordinance replaces general fund dollars with State and Local Fiscal Recovery Fund proceeds.

 

Emergency action is requested to amend the original ordinance as soon as possible so that the related contracts and programs can be administered promptly.

Body

WHEREAS, Ordinance 2216-2022 authorized the Director of the Department of Finance and Management to enter into grant agreements with Planned Parenthood of Greater Ohio and Ohio Women’s Alliance, both 501(c)(3) not for profit corporations, in support of ensuring Access to Reproductive Healthcare; and

 

WHEREAS, Ordinance 2216-2022 also authorized the appropriation and expenditure of $1,000,000.00 related to the aforementioned agreements; and

 

WHEREAS, this Ordinance seeks authority to modify the funding source for these agreements and amends Ordinance 2216-2022 by replacing General Fund appropriations with State and Local Fiscal Recovery Fund proceeds; and

 

WHEREAS, these subaward agreements now shall be awarded pursuant to Columbus City Codes Section 329.30: Process for awarding not-for-profit service contracts estimated to exceed fifty thousand dollars ($50,000.00): and

 

WHEREAS, an emergency exists in the usual daily operations of the Department of Finance and Management in that it is immediately necessary to amend Ordinance 2216-2022 in order to modify the funding source and the related agreements so that the related programs can be administered promptly, thereby preserving the public health, peace, property, safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That Sections 2-9 of ordinance 2216-2022 are hereby amended as follows:

 

                     SECTION 2. That the Director of the Department of Finance and Management is hereby authorized to enter into grant subaward agreements not for profit services contracts with Planned Parenthood of Greater Ohio and Ohio Women’s Alliance in support of ensuring Access to Reproductive Healthcare:                                                              

                                         

                     Planned Parenthood of Greater Ohio - $500,000.00    

                     Ohio Women’s Alliance - $500,000.00                                          

 

SECTION 3. That the Auditor is hereby authorized and directed to appropriate $500,000.00 within the Reimagine Safety subfund, fund 1000,subfund 100019, to the Department of Finance and Management in 10-Transfers, per the accounting codes in the attachment to this ordinance.

 

SECTION 4. That the Auditor is hereby authorized and directed to transfer $500,000.00 within the general fund per the accounting codes in the attachment to this ordinance.

 

SECTION 5. That the Auditor is hereby authorized and directed to appropriate $500,000.00 within the general fund, fund 1000, subfund 100010, to the Department of Finance and Management in 03-Services, per the accounting codes in the attachment to this ordinance.

 

SECTION 6. That the Auditor is hereby authorized and directed to transfer $500,000.00 within the general fund per the accounting codes in the attachment to this ordinance.

 

SECTION 7 3. That per the action authorized in Section 1 of this ordinance, the expenditure of $1,000,000.00 within the general fund Recovery fund, fund 1000 2209, subfund 100010 220902, is hereby authorized per the accounting codes in the attachment to this ordinance.

 

SECTION 4. That these subaward agreements are entered into pursuant to Columbus City Codes Section 329.30: Process for awarding not-for-profit service contracts estimated to exceed fifty thousand dollars ($50,000.00): and

 

SECTION 85That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 96That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.

 

SECTION 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after the earliest period allowed by law passage and approval by the Mayor, or ten days after passage if the Mayor does not approve the same.
