Explanation
BACKGROUND: This legislation authorizes the Director of Finance and Management to modify past, present and future contracts and purchase orders with Express Wash Concepts, LLC, dba Moo Moo Express Car Wash, LLC. Express Wash Concepts, LLC, dba Moo Moo Express Car Wash, has been acquired by Express Wash Holdco, LLC. to be effective May 3, 2021. This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus from Express Wash Concepts, LLC. dba Moo Moo Express Car Wash #82-5188901 to Express Wash Holdco, LLC., FID #82-5183166.
No additional funds are necessary to modify the contract as requested. There is no change in the type of products being procured and the original contract was formally bid. The original terms and conditions remain in effect.
EMERGENCY action is requested to allow payment for services to continue without interruption.

WHEREAS, the Department of Finance and Management and the Fleet Management Division has several contracts and open purchase orders for vehicle washing services for use citywide; and
WHEREAS, Express Wash Concepts, LLC. dba Moo Moo Express Car Wash has been acquired by Express Wash Holdco, LLC. and in addition to notifying the City, Express Wash Holdco, LLC. has agreed to honor the past, present and future contracts and agreements; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management in that it is immediately necessary to modify all contracts and purchase orders established and in process with Express Wash Concepts, LLC., dba Moo Moo Express Car Wash, in order to maintain an uninterrupted supply of services, thereby preserving the public health, peace, property, safety, and welfare; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to modify all past, present and future contracts and purchase orders pursuant to those contracts to reflect the change from Express Wash Concepts, LLC., dba Moo Moo Express Car Wash FID #82-5188901 to Express Wash Holdco, LLC., FID 382-5183166.
SECTION 2. That these modifications are in accordance with relevant provisions of Chapter 329 of the Columbus City Code.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
