BACKGROUND: This legislation authorizes the Finance and Management Director to establish a Universal Term Contract (UTC) for the option to contract for an Electrical Energy Consultant with New River Group DBA Scioto Energy Co. The Department of Public Utilities is the primary user of these services for negotiating electrical energy prices. The Electrical Energy Consultants are used to negotiate electrical energy prices. The term of the proposed option contract would be approximately three (3) years, expiring January 31, 2026, with the option to renew for three (3) additional one (1) year periods. The Purchasing Office opened formal bids on September 22, 2022. In addition, the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO002025.
The Purchasing Office advertised and solicited proposals in accordance with the relevant provisions of Section 329 relating to Request for Proposals (RFQ022747). Four (4) proposals were received.
The evaluation committee consisting of one representative from Department of Public Utilities and two representatives from the Department of Finance and Management scored the written proposals and requested a presentation from the top two firms. The Offerors made their presentations. After review of the committee members’ work the Director of Finance and Management authorized final negotiations and recommends the acceptance of the proposal submitted by New River Group DBA Scioto Energy Co., the highest scoring proposal.

Emergency Designation: The Finance and Management Department respectfully requests this legislation to be considered an emergency ordinance because of volatility in pricing within the energy market.
The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
FISCAL IMPACT: The expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO002025. City Agencies will be required to obtain approval to expend from their own appropriations for their estimated annual expenditures.

To authorize the Finance and Management Director to enter into a Universal Term Contract for the option to purchase Electrical Energy Consulting with New River Group DBA Scioto Energy Co.; to authorize the expenditure of $1.00 from BRPO002025; and to declare an emergency. ($1.00).

WHEREAS, the Electrical Energy Consultant UTC will provide for the purchase of Electrical Energy Consulting used to negotiate energy prices; and,
WHEREAS, the Purchasing Office advertised and solicited formal Requests for Proposals (RFQ022747) for a multi-year contract which were evaluated by a committee resulting in the recommendation of an award to New River; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities in that it is immediately necessary to authorize the Finance and Management Director to enter into a Universal Term Contract for the option to purchase Electrical Energy Consulting because of volatility in pricing within the energy market; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to enter into the following Universal Term Contract for the option for an Electrical Energy Consultant to negotiate energy prices in accordance with Request for Proposal RFQ022747 for a term of approximately three (3) years, expiring January 31, 2026, with the option to renew for three (3) one (1) additional year periods, as follows:
New River Group DBA Scioto Energy Co., Electrical Energy Consulting, $1.00
SECTION 2. That the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO002025 of this ordinance to pay the cost thereof.
SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 4. That for the reason stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
