Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN22-013) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on October 26, 2022. City Council approved a service ordinance addressing the site on November 7, 2022. Franklin County approved the annexation on November 29, 2022 and the City Clerk received notice on December 12, 2022.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN22-013) of KIPP Columbus Foundation for the annexation of certain territory containing 0.59± acres in Mifflin Township.

 

 

Body

 

WHEREAS, a petition for the annexation of certain territory in Mifflin Township was filed on behalf of KIPP Columbus Foundation on October 26, 2022; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on November 29, 2022; and

WHEREAS, on December 12, 2022, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by KIPP Columbus Foundation in a petition filed with the Franklin County Board of Commissioners on October 26, 2022 and subsequently approved by the Board on November 29, 2022 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situated in the State of Ohio, County of Franklin, Township of Mifflin, in Quarter Township 2, Township 1, Range 17, United States Military District, being comprised of all of Lot 4 of the subdivision entitled "Bridgeview Estates", of record in Plat Book 24, Page 39, said Lot 4 being conveyed to Kipp Columbus Foundation by deed of record in Instrument Number 202108050138760, and part of the right of way of Agler Road, as dedicated by deeds and conveyed to Franklin County Commissioners by deeds of record in Official Records 30452H02 and 30737F14 (all references, refer to the records of the Recorder's Office, Franklin County, Ohio) and more particularly bounded and described as follows:

BEGINNING at the northeasterly comer of Lot 3 of said "Bridgeview Estates", in the southerly line of Lot 15 of the subdivision entitled "Bridgeview Estates No. 2", of record in Plat Book 27, Page 67, in the existing City of Columbus corporation line, as established by Ordinance Number 2402-2021, of record in Instrument Number 202201100006416;

Thence easterly, with the southerly line and said corporation line, (Ordinance Number 2402-2021 ), a distance of approximately 81 feet to the northwesterly comer of Lot 5 of said "Bridgeview Estates";

Thence southerly, with the westerly line of said Lot 5, with said corporation line, and crossing the right of way of said Agler Road, distance of approximately 316 feet to a point in the southerly right of way line of said Agler Road, and in the existing City of Columbus corporation line, as established by Ordinance Number 1534-69, of record in Miscellaneous Record 149, Page 181;

Thence westerly, with said southerly right of way line and said corporation line, a distance of approximately 82 feet to a point;

Thence northerly, crossing the right of way of said Agler Road, with the easterly line of said Lot 3, and with said corporation line, a distance of approximately 316 feet to the POINT OF BEGINNING, containing 0.59 acre of land, more or less.

This description is for annexation purposes only and is not to be used for transfer.

Total perimeter of annexation area is 795 feet, all of which is contiguous with the City of Columbus by Ordinance Number 2402-2021 and Ordinance Number 1534-69, giving 100% perimeter contiguity.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
