Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN22-012) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on October 26, 2022. City Council approved a service ordinance addressing the site on November 7, 2022. Franklin County approved the annexation on November 29, 2022 and the City Clerk received notice on December 12, 2022.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN22-012) of Green Lawn Cemetery for the annexation of certain territory containing 0.47± acres in Franklin Township.

 

 

Body

 

WHEREAS, a petition for the annexation of certain territory in Franklin Township was filed on behalf of Green Lawn Cemetery on October 26, 2022; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on November 29, 2022; and

WHEREAS, on December 12, 2022, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by Green Lawn Cemetery in a petition filed with the Franklin County Board of Commissioners on October 26, 2022 and subsequently approved by the Board on November 29, 2022 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situated in the State of Ohio, County of Franklin, Township of Franklin, Virginia Military Survey No. 422 and containing 0.47+/- acres, said 0.47+/- acres being all of that 0.471 acre tract of land as conveyed to Green Lawn Cemetery of record in Instrument No. 202103230052574, part of that 1.164 acre tract of land described as Parcel I 0WD and conveyed to the City of Columbus, Ohio of record in Instrument No. 1998111002885555 and also being part of Lot I of William L. Miners Subdivision of record in Plat Book 2, Page 180, said 0.47+/- more particularly described as follows;

Beginning, at the southeasterly comer of said 0.471 acre tract, said comer also being the southwesterly corner of that Original 5.91 acre tract of land as conveyed to Columbus Cemetery Association of record in Deed Book 912, Page 507, in the northerly line of said Parcel I 0WD and being in the centerline of Greenlawn Avenue (60') (Road Record 9, Page 195);

Thence S 02° 28' 08" W, across said Parcel l 0WD and right-of-way of said Greenlawn Avenue (60') (Road Record 9, Page 195), 30.34+/- feet to a point in the southerly line of said Parcel l 0WD, in the southerly right-of-way line of said Green lawn Avenue (60')(Road Record 9, Page 195), in the northerly line of that 12.652 acre tract of land as conveyed to Scarlett Manor MHP, LLC of record in Instrument No. 202204140057907 and the northerly line of an existing City of Columbus Corporation Line (Case No. 21-14, Ord. #2860-2014, I.N. 201502030013344);

Thence N 87° 45' 07" W, with the southerly line of said Parcel 1 0WD, said southerly right-of-way line, the northerly line of said 12.652 acre tract and along said existing City of Columbus Corporation Line (Case No. 21-14, Ord. #2860-2014, I.N. 201502030013344), 100.00+/- feet to the southeasterly corner of an existing Columbus Corporation Line (Case No. 13-14, Ord. # I 996-2014, 1.N. 201410030130835);

Thence N 02° 28' 08" E, across said Parcel I OWD, across the right-of-way of said Greenlawn Avenue (60')(Road Record 9, Page 196), with the westerly line of said 0.471 acre tract, with the easterly line of a 5.678 acre tract of land as conveyed to Ohio Hospital for Psychiatry LLC of record in Instrument No.

20I40203001372 and along the easterly line of said existing Columbus Corporation Line (Case No. 13- 14, Ord. #1996-2014, I.N. 201410030130835), 235.73+/- feet to a common corner of said 0.471 acre tract and said 5.678 acre tract;

Thence S 87° 31' 52" E, with the northerly line of said 0.471 acre tract, a southerly line of said 5.678 acre tract and along said existing City of Columbus Corporation Line (Case No. 13-14, Ord. # I 996- 2014, I.N. 201410030130835), 100.00+/- feet to a common corner thereof, said corner also being in the westerly line of said Original 5.91 acre tract and being at a southeasterly corner of said existing Columbus Corporation Line (Case No. 13-14, Ord. #1996-2014, I.N. 201410030130835);

Thence S 02° 28' 08" W, with an easterly line of said 0.471 acre tract, a westerly line of said Original 5.91 acre tract and across said Greenlawn Avenue (60')(Road Record 9, Page 196), 205.00+/- feet to the True Point of Beginning. Containing 0.47+/- acres, more or less. The above description was written by Advanced Civil I Design on July 28, 2021. A drawing of the above description is attached hereto and made a part thereof.

The total length of the annexation perimeter is about 671 feet, of which about 436 feet are contiguous with existing City of Columbus Corporation Lines, being about 65.0% contiguous. This annexation does not create any islands of township property.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
