Explanation
BACKGROUND: This legislation authorizes the Director of Public Utilities to amend the water service and sewer service agreements with the City of Whitehall, Ohio. The City of Columbus and the City of Whitehall entered into a sewer service contract on August 10th, 1981 in accordance with Ordinance Number 1878-81, entered into an amended agreement on September 1, 1987 in accordance with Ordinance Number 922-87, and entered into an amended agreement on January 23rd, 2013 in accordance with Ordinance 2766-2012. The current sewer service agreement remains in full force and effect until midnight on January 23, 2053. The City of Columbus and the City of Whitehall entered into a water service agreement on October 24, 1994 in accordance with Ordinance Number 2223-94 and entered into an amended agreement on March 4th, 2013 in accordance with Ordinance 2766-2012. The current water service agreement remains in full force and effect until midnight on March 4th, 2038.
The water and sewer service area boundaries are being updated to reflect corporate boundaries of Whitehall, including the addition of some parcels not currently covered under the existing agreements. All other existing covenants, provisions, terms and conditions thereof shall be binding, and the only purpose of this modification is to modify the service area boundaries.
