Explanation

This ordinance authorizes the Director of the Department of Technology to enter into an agreement with OARnet/OSU, a local non-profit educational institute for continued fiber network and broadband access and related services, in the amount of $81,600.00. The original agreement was authorized by ordinance 0789-2007, which was passed on June 4, 2007 and was most recently authorized on April 18, 2022 with the passage of ordinance 0774-2022.

 

The City's Department of Technology provides Columbus' residents, visitors and businesses with sustained, reliable and efficient technology services, infrastructure and telecommunications. The City focuses on the delivery and operations of vital IT infrastructure network and telecommunication services, continuous service improvement and solutions to enable customer success. OARnet is the provider of the State of Ohio's 100 gigabit backbone network, which provides transport services to state and local government, education, research, and healthcare communities throughout Ohio. OARnet's network is the broadband gateway to a wide array of shared services designed to ensure Ohio is a technology leader.

 

With passage of this ordinance, OARnet will be authorized to provide the City with upgraded internet service for one (1) year, from March 1, 2023 through February 28, 2024, at a cost of $81,600.00. Included in this price is high-speed internet service and a 10-Gigabit port connection at the East and West Data Centers.

 

 

FISCAL IMPACT

In 2021 and 2022, the Department of Technology legislated $100,000.00 and $81,600.00 respectively for continued fiber network and broadband access and related services with OARnet.  The cost for this year (2023) is $81,600.00 for services from March 2023 through February 2024 and is budgeted and available in the Department of Technology, Information Services Division, Operating budget.

 

 

NOT-FOR-PROFIT CONTRACT INFORMATION

This agreement is being awarded under City Code section 329.30, which prescribes the method for contracting with not-for-profit organizations. DoT and OARnet negotiated the cost for provision of the above-described services, the costs for which are outlined in the attachment to this ordinance. The services being authorized herein include upgraded internet service and continued broadband access which must be provided by an outside agency.

EMERGENCY

This ordinance is being submitted with emergency designation. The current contract expires on February 28, 2023. To ensure a contract is in place by the time the current contract expires, emergency action is necessary.

 

Title

To authorize the Director of the Department of Technology to enter into an agreement with OARnet/OSU for continued internet access pursuant to Columbus City Codes sections relating to not-for-profit service contracts; to authorize the expenditure of $81,600.00 from the Department of Technology Information Services Operating Fund; and to declare an emergency. ($81,600.00)

 

Body

WHEREAS, the city has a need for continued internet and broadband service; and

 

WHEREAS, OARnet/OSU, a local non-profit educational institute, provides the above-described service; and

 

WHEREAS, on June 4, 2007, ordinance 0789-2007 passed, authorizing the initial contract; and

 

WHEREAS, the Department of Technology wishes to continue to obtain services from OARnet/OSU for the above-described services; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Technology in that it is immediately necessary to authorize the Director of the Department of Technology enter into contract with OARnet/OSU for continued internet access pursuant to Columbus City Codes sections relating to not-for-profit service contracts so there is no interruption in services, thereby preserving the public health, peace, property, safety, and welfare; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of the Department of Technology be and is hereby authorized to enter into contract with OARnet/OSU for continued internet access pursuant to Columbus City Codes sections relating to not-for-profit service contracts at a cost of $81,600.00 for a term of one (1) year, from on March 1, 2023 through February 29, 2024.

 

SECTION 2. That the expenditure of up to $81,600.00, or so much thereof as may be necessary, is hereby authorized as provided on the attachment to this ordinance. (See attachment 0586-2023EXP).

 

SECTION 3. That this agreement is being awarded under City Code section 329.30, which prescribes the method for contracting with not-for-profit organizations.

 

SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
