Explanation
BACKGROUND: This legislation authorizes the Director of Public Utilities to modify the existing water service agreement with the City of Worthington, Ohio. The City of Columbus, Ohio, and the City of Worthington, Ohio, entered into an original water service contract on May 12, 1983, in accordance with Ordinance 2077-77 passed November 7, 1977. The City of Columbus and the City of Worthington entered into a new water service agreement on April 9, 2008, in accordance with Ordinance 1901-2007; this agreement is for 25 years and will expire in 2033. The City of Columbus and the City of Worthington subsequently entered into a modification to this water service agreement to revise the water service boundaries on June 20, 2013, pursuant to Ordinance 1070-2013 passed May 20, 2013.
The City of Columbus and the City of Worthington also entered into a sewer service agreement on September 28, 2020.
This modification to the water service agreement entered into on April 9, 2008 will modify the water service boundary to be consistent with the existing sewer service boundary.

WHEREAS, the City of Columbus, Department of Public Utilities, and the City of Worthington, Ohio, entered into an original sewer service agreement on May 12, 1983, per Ordinance 2077-77; and
WHEREAS, the City of Columbus, Department of Public Utilities, and the City of Worthington, Ohio, entered into a new water service agreement on April 9, 2008, per Ordinance 1901-2007; and
WHEREAS, the City of Columbus, Department of Public Utilities, and the City of Worthington, Ohio, modified the water service agreement on June 20, 2013; and
WHEREAS, the City of Columbus, Department of Public Utilities, and the City of Worthington, Ohio, would like to modify the water service agreement entered into on April 9, 2008 to update the water service boundary to be consistent with the existing sewer service boundary; and
WHEREAS, it is mutually agreed that Exhibit A of the existing water service agreement entered into on April 9, 2008 be replaced with the revised Exhibit A attached hereto; and
WHEREAS, it is further understood and agreed by and between the City of Columbus, Ohio, and the City of Worthington, Ohio, that as to all other sections under the existing water service agreement entered into on April 9, 2008, the covenants, provisions, terms and conditions thereof shall be binding, and the only purpose of this modification of contract is to update the water service boundary; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Public Utilities is hereby authorized to modify the existing water service agreement entered into on April 9, 2008 with the City of Worthington, Ohio, and to update the water service boundary to be consistent with the existing sewer service boundary.
SECTION 2. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
