Explanation

1.  BACKGROUND  

This ordinance authorizes the Director of the Department of Public Service to execute a professional services contract with Trane U.S., Inc. to design, program, and install the Trane Building Management System for HVAC controls, in the Division of Refuse Collection Lennon Center located at 4260 Morse Road.

 

The Department of Public Service will co-fund this project with the Department of Finance and Management Facilities Division.

 

2.  CONTRACT COMPLIANCE

The contract compliance number for Trane U.S., Inc. is CC001915 and expires 5/10/2023. The vendor will be required to update their contract compliance information before a purchase order can be created.                    

 

3.  FISCAL IMPACT

There are sufficient funds and budgetary authority within the Department of Finance and Management’s Construction Management Capital Improvement Fund - Fund 7733, and the Refuse General Fund - Fund 1000.

 

4.  REQUEST FOR WAIVER OF FORMAL COMPETITIVE BIDDING REQUIREMENTS

A request for waiver of the formal competitive bidding requirements of Columbus City Code Chapter 329 is requested for this purchase so that the Refuse facility controls can be incorporated into the citywide cloud ensemble required for the controls to be monitored and adjusted by facilities staff within one controls solution enhancing efficiencies across multiple facilities. 

 

5.  MINORITY AND WOMAN OWNED BUSINESS ENTERPRISE & SMALL LOCAL BUSINESS ENTERPRISE PROGRAM

This expenditure is for an equipment purchase and is exempt from the MBE/WBE program

 

6.  EMERGENCY DESIGNATION

The department requests emergency designation for this ordinance to prevent interruption of HVAC service at the Division of Refuse Collection Lennon Center located at 4260 Morse Road, and Division of Fleet Management Service garage, located at the same address.

To authorize the Director of the Department of Public Service to execute a professional services contract with Trane U.S., Inc.; to authorize the expenditure of up to $66,000.00 from the Construction Management Capital Improvements Fund ($66,000.00); to authorize the expenditure of $150,000.00 from the Division of Refuse Collection General Fund ($150,000.00); to authorize the waiver of the competitive bidding requirements of the Columbus City Codes; and to declare an emergency.  ($216,000.00)

 

Body

WHEREAS,  the Department of Public Service, Division of Refuse Collection has a need for a professional services contract to design, program, and install the Trane Building Management System for HVAC controls; and

 

WHEREAS, the Director of Public Service has need to execute a professional services contract with Trane U.S., Inc.; and

 

WHEREAS, the Division of Finance and Management is authorized to expend $66,000.00 from the Construction Management Capital Improvements Fund; and

 

WHEREAS, the Department of Public Service is authorized to expend $150,000.00 Division of Refuse Collection General Fund; and

 

WHEREAS, it is necessary for Council to authorize a waiver of the competitive bidding requirements of Columbus City Code to procure this service; and 

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director of Public Service to execute a contract with Trane U.S., Inc. to design, program, and install the Trane Building Management System for HVAC controls, in the Division of Refuse Collection Lennon Center located at 4260 Morse Road, to prevent interruption of HVAC services at a refuse facility in the summer months, thereby preserving the public health, peace, property, safety, and welfare; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

 

SECTION 1.  That the Director of Public Service be, and hereby is, authorized to enter into a professional services contract with Trane U.S., Inc. to design, program, and install the Trane Building Management System for HVAC controls in the Division of Refuse Collection Lennon Center located at 4260 Morse Road.

 

SECTION 2.  That the expenditure of $66,000.00 or as much thereof as may be needed, is hereby authorized in Fund 7733 (Construction Management Capital Improvements Fund), Dept-Div 4550 (Finance and Management), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the expenditure of $150,000.00 or as much thereof as may be needed, is hereby authorized in Fund 1000 (Refuse General Fund)  Dept-Div 5902 (Division of Refuse Collection), in Object Class 03 (Services) per the accounting codes in the attachment to this ordinance.

 

SECTION 4. That City Council finds it is in the best interest of the City of Columbus to waive the formal competitive bidding requirements of City Code Chapter 329.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
