Explanation  

1.  BACKGROUND

This ordinance authorizes the Director of the Department of Public Utilities to enter into a contract renewal with Patrick Engineering Inc., for the O’Shaughnessy Hydro Turbine Improvements project, CIP #690444-100000, in an amount up to $900,482.00.

 

The goal of this project is to repair major components for the O’Shaughnessy Hydro Turbine Facility. The facility is more than thirty years old and its major components are in need of repair, including the turbines, generators, controls, and electrical gear.  Currently, only one of the two turbines is operational.  This contract provides engineering services to design the improvements needed to restore the facility to fully working condition. 

 

This Contract Renewal (No. 3) requests additional funding for Phase 3 - Engineering Services during Construction.

1.2. Reason other procurement processes are not used: 

This is a contract renewal.  Patrick Engineering Inc., has been providing these services under contract with planned renewals to add funding for future years.  Rebidding the contract and using another company would be more expensive as the new company would need to spend time learning and redoing work already performed by Patrick Engineering Inc.

 

1.3. How the cost of renewal was determined:

Cost was determined between negotiations with the Department of Public Utilities and the vendor based on rates established under the existing contract.

 

2.  ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT 

The refurbished power plant will produce electrical power supplied to everyone on the regional grid with zero carbon emissions.

 

3.  CONTRACT COMPLIANCE INFO

Patrick Engineering Inc.’s contract compliance number is CC-007237 and expires 8/11/22. The contract renewal will not be executed until Patrick Engineering’s contract compliance is renewed.

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) were not required for this contract as no State or Federal money will be used to pay for contracted services.

 

4.  MINORITY AND WOMAN OWNED BUSINESS ENTERPRISE & SMALL LOCAL BUSINESS ENTERPRISE PROGRAM

This contract was put in place prior to the implementation of the City of Columbus MBE/WBE Program and is not subject to the requirements of that program.  Patrick Engineering Inc. is classified as a majority company by the City’s Office of Diversity and Inclusion.  Patrick Engineering is using the following subconsultants for this contract renewal:

5.  FISCAL IMPACT

There are sufficient funds within the Water G.O. Bond Fund, Fund 6006, for this expenditure.  An amendment to the 2022 Capital Improvement Budget is needed to align budget authority with the proper project.  It is necessary to transfer funds and appropriation between projects in Fund 6006 to align cash and appropriation with the proper project.

WHEREAS, Contract No. EL016667 was authorized by Ordinance No. 2690-2014, passed December 15, 2014, was executed on January 27, 2015, and approved by the City Attorney on February 2, 2015, for the O’Shaughnessy Hydro Turbine Facilities Improvements Project; and

 

WHEREAS, Contract Modification No. 1 under PO079426, was authorized by Ordinance No. 1859-2017, passed July 31, 2017, was executed on September 1, 2017, and approved by the City Attorney on September 8, 2017 for Phase 2 - Preliminary and Detailed Design Services, for the O’Shaughnessy Hydro Turbine Facilities Improvements Project; and

 

WHEREAS, Contract Renewal No. 2 under PO079426, was authorized by Ordinance No. 1859-2017, passed July 31, 2017, was executed on September 1, 2017, and approved by the City Attorney on January 28,2021 for Phase 2 - Preliminary and Detailed Design Services, for the O’Shaughnessy Hydro Turbine Facilities Improvements Project; and

 

WHEREAS, it is necessary to authorize the Director of Public Utilities to renew the professional engineering services agreement with Patrick Engineering Inc., for Phase 3 - Engineering Services During Construction, for the O’Shaughnessy Hydro Turbine Facilities Improvements Project; and

 

WHEREAS, it is necessary to authorize an amendment to the 2022 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and

 

WHEREAS, it is necessary to authorize a transfer and expenditure in the amount of $900,482.00 within the Water G.O. Bond Fund, for the Division of Water; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2022 Capital Improvements Budget authorized by Ordinance 1896-2022 be amended as follows to establish sufficient budget authority for this project:

SECTION 2. That the transfer of $900,482.00 or so much thereof as may be needed, is hereby authorized between projects within Fund 6006 - Water G O Bond Fund, per the account codes in the attachment to this ordinance. 

 

SECTION 3.  That the Director of Public Utilities is hereby authorized and directed to renew the professional engineering services agreement with Patrick Engineering Inc., for the O’Shaughnessy Hydro Turbine Facilities Improvements Project, in an amount up to $900,482.00.

 

SECTION 4. That the expenditure of $900,482.00, or so much thereof as may be needed, is hereby authorized in Fund 6006 - Water G.O. Bonds Fund, in Object Class 06, Capital Outlay, per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 8.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
