Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to establish a Universal Term Contract (UTC) for the option to purchase Water Meters, Yokes, Meter Setters and Appurtenances with Badger Meter, Inc. The Division of Water is the primary user for these specific water meters and related items used for installation in the City’s water distribution system. The term of the proposed option contract would be approximately one (1) year, expiring March 31, 2025, with no option to renew. In addition, the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO002726.
A Water Meters, Yokes, Meter Setters and Appurtenances contract previously existed with Badger Meter Inc. and expired on March 31, 2024. The Division of Water implemented an Enhanced Meter Project (EMP) whereby 80,000 PD meters are to be installed annually. A waiver of competitive bidding is requested because Badger Meter Inc. is the only vendor who provides the PD meter. A new contract needs to get established with this vendor to continue the deployment of meters for the Enhanced Meter Project (EMP).
The Purchasing Office is recommending award as follows:
Badger Meter Inc., CC# 007720 expires 12/28/2025, Items: Water Meters, Yokes, Meter Setters and Appurtenances, $1.00
Total Estimated Annual Expenditure: $1,240,000.00, Division of Water, primary user.
Emergency Designation: The Finance and Management Department respectfully requests this legislation be considered an emergency ordinance because the prior contract with Badger Meter Inc. expired March 31, 2024 and a new contract with this vendor is needed to ensure meters are readily available to continue installations for the Enhanced Meter Project (EMP).
This company is not debarred according to the Excluded Parties listing of the Federal Government and are not listed in the Auditor of States database for Findings for Recovery.
FISCAL IMPACT: The expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO002726. City Agencies will be required to obtain approval to expend from their own appropriations for their estimated annual expenditures.

To authorize the Finance and Management Director to enter into a contract for the option to purchase Water Meters, Yokes, Meter Setters and Appurtenances with Badger Meter Inc.; to authorize the expenditure of $1.00; to waive the provisions of competitive bidding; and to declare an emergency. WHEREAS, the Water Meters, Yokes, Meter Setters and Appurtenances UTC will provide for the purchase of water meters and related items used for installation in the City’s water distribution system.; and,
WHEREAS, the Purchasing Office has negotiated a one (1) year Universal Term Contract for the option to obtain Water Meters, Yokes, Meter Setters and Appurtenances with the same supplier that has been installing the meters for the Enhanced Meter Project for the Division of Water; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities in that it is immediately necessary to authorize the Finance and Management Director to enter into a Universal Term Contract with Badger Meter Inc., for the option to purchase Water Meters, Yokes, Meter Setters and Appurtenances, to continue the installation of water meters as the prior contract with Badger expired on March 31, 2024, all for the immediate preservation of the public health, safety, and welfare; and now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to enter into the following contract for the option to purchase Water Meters, Yokes, Meter Setters and Appurtenances for a term of approximately one (1) year, expiring March 31, 2025, as follows:
Badger Meter Inc., Items: Water Meters, Yokes, Meter Setters and Appurtenances, $1.00
SECTION 2. This Council finds it is in the best interest of the City of Columbus to waive the relevant provisions of Columbus City Codes Section 329 pertaining to competitive bidding, to permit the aforementioned purchase.
SECTION 3. That the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO002726 of this ordinance to pay the cost thereof.
SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
