Title: To declare the necessity to construct the sanitary sewer improvements known as the Lockbourne Road Sewer Assessment Project, and to approve the plans, specifications, estimates and the profiles in accordance with the assessment procedures of the Columbus City Charter, for the Division of Sewerage and Drainage.

Explanation
 
This resolution declares the intention of the City to initiate a special assessment for the construction of sanitary sewer improvements to an existing, unsewered residential area along Lockbourne Road from SR 104 to Watkins Road and portions of Evergreen Road and Koebel Road.  The installation of this sanitary infrastructure is further declared necessary to eliminate groundwater pollution concerns caused by failing, existing on-site sewage systems that have been documented by the Columbus Health Department.  Unlike past sanitary sewer assessment projects, this project is not the result of a valid petition initiated by the property owners.  The residential area to be included within this special assessment project include: 23 parcels on Lockbourne Road (which include 5 vacants); 13 parcels on Koebel (which includes 3 vacants); 24 parcels on Evergreen Road (which include 4 vacants).  A total of 60 parcels (12 of which are vacant) are involved in the assessment area.
 
This preliminary resolution is required by Section 166 of the City Charter for purposes of establishing the method of assessment, the mode of payment, the number of annual installments, and the portion of the cost to be borne by the City.  This resolution further provides a description of the lots and lands to be assessed, and approves the plans, specifications, estimates and profiles for the proposed improvements.  Upon adoption of this resolution, the Division of Sewerage and Drainage shall file with the City Clerk an Assessment Report.  This report will list the estimated assessment amount for each lot, the name of the property owner, and the Franklin County Auditor's Parcel Number.  The City Clerk will than issue individual notices to each property owner informing them of their estimated assessment in accordance with Section 170 of the City Charter.

WHEREAS, the City of Columbus's Health Department has identified a residential area that includes lots and lands in the area along Lockbourne Road from SR 104 to Watkins Road and portions of Evergreen Road and Koebel Road., that are located within the southeast quadrant of the City of Columbus; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities have caused the preparation of plans, specifications, estimates and profiles for the construction of sanitary sewer improvements for this area; and
 
WHEREAS, in accordance with Section 166 of the Charter of the City of Columbus, Ohio, it is required for this Council to adopt this preliminary resolution that declares it necessary to construct the aforementioned sanitary sewer improvements, and to approve the completed plans, specifications, estimates and profiles for the construction of said improvements in order to improve the health and safety of its citizens to be served by these improvements, now, therefore,
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That this City Council hereby deems it necessary to construct sanitary sewer improvements known as the Lockbourne Road Sewer Assessment Project (CIP 650620), and further approves the plans, specifications and profiles identified as Drawing No. CC12757, on file in the offices of the Division of Sewerage and Drainage.
 
Section 2.  That the sanitary sewer service improvements shall be assessed in proportion to the special benefits which may result from the improvement upon the following described lots and lands, to wit:  All lots and lands bounding and abutting upon the proposed improvement, which said lots and lands are hereby determined to be specially benefited by said improvement, and in an amount to be determined.
 
Section 3.  That the assessment so to be levied shall be paid in twenty semi-annual installments, with the interest on deferred payments at a rate not exceeding the prevailing interest, provided that the owners of any property assessed may, at his/her option, pay such assessment or any number of installments of the same at any time after such assessment has been levied.
 
Section 4.  That the City's share in the cost of the improvements shall include the cost of the project design services, inspection; and the construction costs associated with the right-of-way pavement restoration; and intersection crossings.
 
Section 5.  That notes of the City of Columbus, Ohio, shall be issued in anticipation of the issuance of bonds to be issued in the anticipation of the collection of the assessments by installments, and in an amount equal thereto.
 
Section 6.  That this resolution shall take effect and be in force from and after the earliest period allowed by law.
