Title
 
To declare the necessity and intent to appropriate permanent easements in, over, under and through real estate in connection with the Miscellaneous Sidewalk Acquisition of Permanent Sidewalk Easement at the South East Corner of North High Street and Sunnyside Lane project.
 
Body
 
WHEREAS,      the City of Columbus is engaged in the Miscellaneous Sidewalk Acquisition of Permanent Sidewalk Easement at the South East Corner of North High Street and Sunnyside Lane project.; and,
 
WHEREAS,      in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to declare the necessity and intent to appropriate permanent easements in, over, under and through the hereinbefore described real estate necessary for the aforementioned project; now, therefore:
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That this Council hereby declares the necessity and intent to appropriate permanent easements in, over, under and through the following described real estate necessary for the Miscellaneous Sidewalk Acquisition of Permanent Sidewalk Easement at the South East Corner of North High Street and Sunnyside Lane Project, project # 590105, pursuant to and in accordance with the Charter of the City of Columbus, Columbus City Code (1959) Revised, Chapter 909, the Constitution of the State of Ohio and Ohio Revised Code, Chapter 719; to-wit:
0.006 +/- ACRE
 
      Situated in the State of Ohio, county of Franklin, City of Columbus, being in part of farm lot number 86, Quarter Township 3, Township 3 north, range 18 west, U.S. Military Lands, being a 0.006 acres out of a 1.324 acre tract of land as conveyed to William H. Hadler of recorded in Interment Number 200107130160025. (all references refer to the records of the recorder's office, Franklin County, Ohio) said 0.006 acre permanent sidewalk easement being more particularly bounded and described as follows:
      Beginning at a point at the southerly right-of-way line of Sunnyside Lane (50' in width) with the easterly right-of-way line of North High Street (66' in width) said point being the point of beginning for the herein described 0.006 acre permanent sidewalk easement;
      thence south 89°51'00" east, with the southerly right-of-way line of said Sunnyside Lane and the northerly line on said 1.324 acre tract a distance of 20.50 feet to a point;
      thence over and across said 1.324 acre tract, south 38°37'49" west a distance of 32.85 feet, to a point in the easterly right-of-way line of said north high street;
      thence north 00°00'00" east with the easterly right-of-way line of said North High Street a distance of 25.71 feet to the point of beginning, containing 0.006 acres of land, more or less;
 
 
      Section 2.      That the City Attorney be and hereby is authorized to cause a written notice of the adoption of this resolution to be served upon the owners, persons in possession of or persons having a real or possible interest of record in the above described premises in the manner provided by law.
 
Section 3.      That this resolution shall take effect and be in force from and after the earliest period allowed by law.
