Explanation
This legislation authorizes the Director of Public Utilities to enter into contract with AEP T&D Services, LLC for the purpose of providing training services related to a journeyman electrical apprenticeship program that is formal and progressive. The proposed training is manifestly impractical to bid as AEP is the only vendor able to offer up to five (5) complete apprenticeship programs at their local facility eliminating the need for travel and additional expenses. AEP is also able to offer additional elective and customized classes to meet the specific needs of the Division of Power.
This contract will be for one (1) year from the date of execution, with the option to renew annually with the approval of City Council and the appropriation of necessary funds.

FISCAL IMPACT: $200,000.00 is budgeted and needed for this purchase in the Division of Power’s Operating Fund. This ordinance is contingent upon the passage of the 2020 Operating Budget Ordinance 2926-2019.

Title
To authorize the Director of Public Utilities to enter into contract with AEP T&D Services, LLC for the purpose of providing training services related to a journeyman electrical apprenticeship program; to waive the competitive bidding provisions of the City Code; and to authorize the expenditure of $200,000.00 from the Power System Operating Fund. ($200,000.00)

WHEREAS, the Department of Public Utilities has a need to establish a new contract with AEP T&D Services, LLC for the purpose of providing training services related to a journeyman electrical apprenticeship program; for the Division of Power; and
WHEREAS, due to the nature of the training required and the lack of programs available locally that perform said training, it is in the City’s best interest to waive competitive bidding and enter into contract with AEP T&D Services, LLC; and
WHEREAS, the Department of Public Utilities currently has a need for training services to prepare staff to safely and effectively perform the tasks covered by this program; and
WHEREAS, AEP T&D Services, LLC has the skills, staff, and fully-equipped local training facility to train the employees of the Division of Power; and
WHEREAS, the term of this contract is for the period of one (1) year from the date of execution by the City of Columbus, with the option to renew for additional training for four additional one-year periods subject to and conditioned upon the approval of City Council, and appropriation and certification of funds by the City Auditor; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities to authorize the Director to enter into a contract with AEP T&D Services, LLC for training services related to a journeyman electrical apprenticeship program; thereby, preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Utilities is hereby authorized to enter into contract with AEP T&D Services, LLC, in accordance with the terms and conditions as shown in the agreement on file in the office of the Department of Public Utilities. Total contract amount is $200,000.00.
SECTION 2. That said firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power.
SECTION 3. That Council finds it in the City's best interest to waive the competitive bidding provisions of Chapter 329 of the City Code for the new contract with AEP T&D Services, LLC.
SECTION 4. That the expenditure of $200,000.00 or so much thereof as may be needed, be and the same hereby is authorized per the accounting codes in the attachment to this ordinance.
SECTION 5. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 6. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
