Explanation

AN19-012

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN19-012) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on November 5, 2019. City Council approved a service ordinance addressing the site on November 18, 2019. Franklin County approved the annexation on November 26, 2019 and the City Clerk received notice on December 16, 2019.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN19-012) of Christian Ottaway for the annexation of certain territory containing 0.46± acres in Franklin Township.

Body

WHEREAS, a petition for the annexation of certain territory in Franklin Township was filed by Christian Ottaway on November 5, 2019; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on November 26, 2019; and

WHEREAS, on December 16, 2019, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by Christian Ottaway in a petition filed with the Franklin County Board of Commissioners on November 5, 2019 and subsequently approved by the Board on November 26, 2019 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

The following described 0.464 acre tract is situated in the State of Ohio, Franklin County, Franklin Township, VMS 1454, being all of a 0.464 acre tract (Parcel 140-007224-00, 0.568 original acre tract) conveyed to Christian J Ottaway by Instrument Numbers 201903040024355, 201903040024356, 201903040024357 and 201903040024358, and being more particularly described as follows:

Beginning at the Southeast corner of a 0.105  acre tract conveyed to Franklin County Commissioners by Instrument Number 201909050114330, the Southwest corner of said 0.464 acre tract, in the North line of a 1.00 acre tract conveyed to Joshua M Kulp by Instrument Number 200904230056961 and being in the East line of Gantz Road (right-of-way width varies);

Thence, with the East line of said 0.105 acre tract and said East line of Gantz Road, with the following two courses:

1) North 13° 57' 30" East a distance of 78.93 feet to a point;

2) with a curve to the right, radius of 30.00 feet, arc length of 47.19 feet, Chord bears North 59° 01' 15" East a distance of 42.47 feet to the South line of Willow Run Road as dedicated by Willow Run Subdivision as recorded in Plat Book 38 page 62 and in the existing corporation line by Case Number 21-74, Ordinance Number 1703-74 as recorded in 163-887

 

Thence, with the North line of said 0.464 acre tract, the South line of Willow Run Road and said corporation line, South 75° 55' 00" East a distance of 156.93 feet to the Northwest corner of Lot 35 of Willow Run Resubdivision as recorded in Plat Book 49 page 101;

 

Thence, with the West line of said Lot 35 and said corporation line, South 13° 57' 30" West a distance of 109.00 feet to the North line of said Kulp's 1.00 acre tract and being a corner to said corporation line;

 

Thence, with the North line of said 1.00 acre tract, North 75° 55' 00" West a distance of 187.00 feet returning to the Point of Beginning, containing 0.464 Acres more or less. Bearings are based on the centerline of Gantz Road (North 13° 57' 30" East) as described on Plat Book 38 page 62.

 

The total perimeter of the annexation area is 579.1 feet, of which 265.9 feet is contiguous with the City of Columbus (having 45.9% contiguity). SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
