Explanation

BACKGROUND: This legislation authorizes the Finance and Management Director to establish a Universal Term Contract (UTC) for the option to purchase Water Meters, Yokes, Meter Setters and Appurtenances with Badger Meter, Inc. The Division of Water is the primary user for these specific water meters and related items used for installation in the City’s water distribution system. The term of the proposed option contract would be approximately one (1) year, expiring March 31, 2025, with no option to renew. In addition, the expenditure of $1.00 is hereby authorized from General Budget Reservation BRPO002726.

A Water Meters, Yokes, Meter Setters and Appurtenances contract previously existed with Badger Meter Inc. and expired on March 31, 2024. The Division of Water implemented an Enhanced Meter Project (EMP) whereby 80,000 PD meters are to be installed annually. A waiver of competitive bidding is requested because Badger Meter Inc. is the only vendor who provides the PD meter. A new contract needs to get established with this vendor to continue the deployment of meters for the Enhanced Meter Project (EMP).

The Purchasing Office is recommending award as follows:

Badger Meter Inc., CC# 007720 expires 12/28/2025, Items: Water Meters, Yokes, Meter Setters and Appurtenances, $1.00
Total Estimated Annual Expenditure: $1,240,000.00, Division of Water, primary user.

Emergency Designation: The Finance and Management Department respectfully requests this legislation be considered an emergency ordinance because the prior contract with Badger Meter Inc. expired March 31, 2024 and a new contract with this vendor is needed to ensure meters are readily available to continue installations for the Enhanced Meter Project (EMP).

This company is not debarred according to the Excluded Parties listing of the Federal Government and are not listed in the Auditor of States database for Findings for Recovery.
