Explanation
1. BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with UCL, Inc., in the amount of $871,200.00, for the Morse Road North Tank Interior Painting Project, Division of Power and Water Contract Number 2009.
This project consists of removing and replacing the interior coating system of the Morse Road North 10 million gallon water storage tank.  There are significant paint failures on the ceiling of the interior of this tank that need addressed.
2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT:  There are currently 37 water tanks in the distribution system maintained by the City of Columbus, Division of Power and Water.  To keep these tanks in optimal condition, the equivalent of two tank interiors and exteriors need to be recoated each year.  
 
3. CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened seven bids on February 15, 2012 from:

The Division requested a base bid consisting of an epoxy paint system as well as an alternate bid for an elastomeric polyurethane system.  The base bid is a paint system that has been applied to the Division's water storage tanks successfully in the past.  The alternate bid is a more labor intense system to install that requires much more experience and if not installed properly could delay the project significantly.  However, if the system is installed correctly, it could add 25% to the design life of the painting.  Based on the alternate bid being 28% higher than the base bid as well as the associated risks of installation of this type of system, the Division selected the base bid for award.
UCL, Inc.'s bid was deemed the lowest, most responsive and responsible bid in the amount of $871,200.00.  Their Contract Compliance Number is 31-1697362 (expires 2/15/13, Majority).  Additional information regarding each bidder, description of work, contract time frame and detailed amounts can be found on the attached Information form.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against UCL, Inc.
4. FISCAL IMPACT:  A transfer of funds within the Water Works Enlargement Voted Bonds Fund will be necessary, as well as an amendment to the 2011 Capital Improvements Budget.

WHEREAS, seven bids for the Morse Road North Tank Interior Painting Project were received and publicly opened in the offices of the Director of Public Utilities on February 15, 2012; and
WHEREAS, the lowest, most responsive and responsible bid was from from UCL, Inc., for the base bid (epoxy system), in the amount of $871,200.00; and
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract for the Morse Road North Tank Interior Painting Project with UCL, Inc.; and
 
WHEREAS, it is necessary for this Council to authorize the transfer and expenditure of funds within the Water Works Enlargement Voted Bonds Fund, for the Division of Power and Water; and  
 
WHEREAS, it is necessary to authorize an amendment to the 2011 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and
WHEREAS, it has become necessary in the usual daily operation of the Division of Power and Water, Department of Public Utilities, to authorize the Director of Public Utilities to enter into a construction contract with UCL, Inc., for the Morse Road North Tank Interior Painting Project, for the preservation of the public health, peace, property and safety; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to award and execute a construction contract for the Morse Road North Tank Interior Painting Project with the lowest, most responsive, and responsible bidder, UCL, Inc., 2025 Stapleton Court, Cincinnati, Ohio 45240; in the amount of $871,200.00; in accordance with the terms and conditions of the contract on file in the Office of the Division of Power and Water.
SECTION 2.  That the City Auditor is hereby authorized to transfer $871,200.00 within the Department of Public Utilities, Division of Power and Water, Water Works Enlargement Voted Bonds Fund, Fund No. 606, Dept/Div. No. 60-09, Object Level Three 6621, as follows:

SECTION 4.  That the expenditure up to $871,200.00 is hereby authorized for the Morse Road North Tank Interior Painting Project within the Water Works Enlargement Voted Bonds Fund, Fund No. 606, Division 60-09, Project No. 690477-100003 (carryover), Object Level Three 6621, OCA Code 664773.  
 
SECTION 5.  That said construction company shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power and Water.
SECTION 6.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 7.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
SECTION 9.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
